【摘要】：安全是民航業(yè)的重中之重,民航業(yè)歷來都將安全放在首位,民航安全也與國家安全密不可分。如今,在網(wǎng)絡(luò)信息技術(shù)快速發(fā)展的時代背景下,隨著在民航領(lǐng)域越來越多地采用網(wǎng)絡(luò)信息技術(shù),民航網(wǎng)絡(luò)信息安全迅速地成為保護民航安全領(lǐng)域的新對象。民航網(wǎng)絡(luò)信息系統(tǒng)與飛行安全密切相關(guān),民航網(wǎng)絡(luò)信息系統(tǒng)一旦遭到黑客攻擊竊取機密資料或無線電通信系統(tǒng)被惡意干擾,或者飛機運行中的網(wǎng)絡(luò)信息系統(tǒng)被攻擊等,都將會使飛行安全甚至國家安全受到嚴重威脅,整個民航業(yè)都將遭受重大的實際損失,以及潛在的對民航業(yè)人員及旅客對飛行安全信心的影響。本文將對信息泄露、無線電干擾等民航網(wǎng)絡(luò)信息安全問題現(xiàn)狀進行分析,并通過對中、美、澳等國內(nèi)外有關(guān)民航網(wǎng)絡(luò)信息安全的法律規(guī)定以及國際公約的比較研究,提出解決我國民航網(wǎng)絡(luò)信息安全問題的法律對策,如制定民航網(wǎng)絡(luò)信息安全管理規(guī)章。
[Abstract]:Safety is the most important part of civil aviation industry. Civil aviation industry has always put safety in the first place, and civil aviation safety is closely related to national security. Nowadays, under the background of the rapid development of network information technology, with the increasing use of network information technology in the field of civil aviation, civil aviation network information security has rapidly become a new object in the field of civil aviation security protection. The civil aviation network information system is closely related to the flight safety. Once the civil aviation network information system is attacked by hackers to steal confidential information or the radio communication system is maliciously interfered, or the network information system in operation of the aircraft is attacked, etc. Both will make flight safety and even national security seriously threatened, and the entire civil aviation industry will suffer great actual losses, as well as the potential impact on civil aviation personnel and passengers' confidence in flight safety. This paper will analyze the current situation of civil aviation network information security, such as information leakage, radio interference, etc., and make a comparative study of the laws and regulations on civil aviation network information security at home and abroad, such as China, the United States, Australia and other countries, as well as the international conventions. This paper puts forward legal countermeasures to solve the problem of civil aviation network information security, such as formulating civil aviation network information security management regulations.
