【摘要】：正不少網(wǎng)絡(luò)公司利用爬蟲技術(shù),將已經(jīng)發(fā)布在網(wǎng)絡(luò)上的信息經(jīng)過系統(tǒng)整理,作為自己的產(chǎn)品向受眾推廣。這是一種新型的經(jīng)營模式,也是一種特殊的網(wǎng)絡(luò)衍生產(chǎn)品。爬蟲技術(shù)的基本特征就在于,利用網(wǎng)絡(luò)特殊搜索技術(shù),深入各個網(wǎng)站將相關(guān)聯(lián)的信息搜索出來,并呈現(xiàn)在受眾的面前。這種做法是否侵犯個人隱私,是否破壞言論自由,是否損害公共利益,是否損害其他數(shù)據(jù)財產(chǎn)擁有者的財產(chǎn)所有權(quán),是否涉及不正當(dāng)競爭,有待進(jìn)一步分析。最近,美國加利福尼亞州北區(qū)聯(lián)邦
