【摘要】：網(wǎng)絡犯罪社群是一種新型有組織犯罪形態(tài),社群成員基于犯罪共意,或為家族式犯罪團伙,或由熟人創(chuàng)建,或由互不相識之人通過網(wǎng)絡平臺勾連,結伙實施違法犯罪活動;其組織結構主要有嚴密的層級型、松散的資源分享型、緊密的企業(yè)型以及產(chǎn)業(yè)鏈型等多種形態(tài);其組織文化有接近正常社會文化和黑社會幫派文化兩種類型;它通過"信息流、知識流、情感流、指令流、資金流和物流"等"六流融合機制"實現(xiàn)虛擬化運行,依托互聯(lián)網(wǎng)呈現(xiàn)"八方匯聚、來源復雜、規(guī)模龐大、分布廣泛"的新特點;其反偵查手段多樣,隱蔽性強,傳統(tǒng)的以執(zhí)法機構為中心的治安管理與案偵模式難以有效應對。基于公共治理理念,推進虛擬社區(qū)警務,由警察單兵作戰(zhàn)轉向網(wǎng)絡社區(qū)協(xié)同參與;實施第三方警務,運用法律杠桿、合作與外包策略,說服、激勵或強制各方承擔網(wǎng)絡安全責任;強化情報主導警務,加強情報搜集與綜合分析研判,精確打擊網(wǎng)絡犯罪社群,是應對網(wǎng)絡犯罪社群威脅的有效路徑。
[Abstract]:Cyber crime community is a new type of organized crime, the crime is based on the idea of community members, or for family or acquaintances by criminal gangs, create, or by strangers who hook through the network platform, the implementation of gang criminal activities; its organizational structure mainly has the strict hierarchy, loose resource sharing type, various forms of enterprise and industry chain closely; there are close to normal social culture and culture of underworld gang two types of organizational culture; it is through the "information flow, knowledge flow, emotion flow, instruction flow, capital flow and logistics" and "six flow fusion mechanism for virtual operation, relying on the" the Internet has "eight party gathering source complex, large scale, new characteristics of wide distribution"; the anti detection means diversity, concealment, by law enforcement agencies as the center of the public security administration and the investigation of the case of the traditional mode of public governance based on difficult to respond effectively. The management idea, promote the virtual community policing, police from individual combat to network collaborative community participation; the implementation of the third party policing, the use of legal leverage to convince cooperation and outsourcing strategy, incentive, or forced parties to assume responsibility for network security; strengthen intelligence led policing, strengthen intelligence collection and comprehensive analysis, accurate combat network crime is the community. The effective path to deal with cyber crime community threat.
