【摘要】：近幾年隨著經(jīng)濟(jì)的發(fā)展,人們環(huán)保意識(shí)的不斷提升,循環(huán)經(jīng)濟(jì)的發(fā)展理念被提出。逆向物流產(chǎn)業(yè),是提高資源利用效率和發(fā)展循環(huán)經(jīng)濟(jì)的重要手段。當(dāng)前我國(guó)逆向物流的發(fā)展開(kāi)始形成一定規(guī)模,逆向物流能降低企業(yè)成本、提高服務(wù)價(jià)值、提高環(huán)境業(yè)績(jī),企業(yè)在認(rèn)識(shí)到上述重要作用之后,紛紛開(kāi)始了逆向物流業(yè)務(wù)體系建設(shè)。同西方發(fā)達(dá)國(guó)家相比,我國(guó)逆向物流發(fā)展水平還很落后,許多社會(huì)和環(huán)境問(wèn)題仍亟待解決。為推動(dòng)我國(guó)逆向物流的發(fā)展,本文從完善逆向物流法律法規(guī)的角度出發(fā),主要分為以下幾個(gè)部分:第一部分,本文在查閱大量國(guó)內(nèi)外文獻(xiàn)的基礎(chǔ)上,對(duì)逆向物流的概念及特征作了相關(guān)介紹,并結(jié)合當(dāng)前我國(guó)逆向物流行業(yè)的發(fā)展現(xiàn)狀,分析了逆向物流法律法規(guī)的不足之處。第二部分,本文從立法模式、法律原則、法律制度三個(gè)方面,結(jié)合德國(guó)、美國(guó)和日本現(xiàn)有的逆向物流法律法規(guī),逐一分析其領(lǐng)先于世界的先進(jìn)經(jīng)驗(yàn)及啟示。第三部分,本文從環(huán)境保護(hù)、循環(huán)經(jīng)濟(jì)和可持續(xù)發(fā)展的理論基石出發(fā),提出了完善逆向物流法律法規(guī)一方面要堅(jiān)持促進(jìn)經(jīng)濟(jì)發(fā)展、保護(hù)環(huán)境和節(jié)約資源相結(jié)合原則,另一方面要秉持前瞻性和利益平衡性原則。最后,本文提出了健全逆向物流法律體系建設(shè)的一系列措施,具體包括:首先我們要準(zhǔn)確給主體和客體下定義,為有序地開(kāi)展逆向物流活動(dòng)提供前提;其次要明確逆向物流法律責(zé)任的主體,不僅要規(guī)制企業(yè)責(zé)任,還要融入政府和消費(fèi)者這二者,發(fā)揮各自不可替代的作用;同時(shí),面對(duì)我國(guó)逆向物流立法分散和可操作性低的現(xiàn)狀,我國(guó)應(yīng)盡快制定相應(yīng)的實(shí)施細(xì)則,增強(qiáng)其可操作性;本文最后從監(jiān)督機(jī)制和獎(jiǎng)懲機(jī)制兩個(gè)角度,對(duì)逆向物流法律法規(guī)的完善進(jìn)行了概括式的歸納。
[Abstract]:In recent years, with the development of economy, people's environmental awareness, the concept of circular economy is put forward. The reverse logistics industry, is an important means to improve resource utilization efficiency and the development of circular economy. The development of reverse logistics in China started to form a certain scale, the reverse logistics can reduce the cost of enterprise, improve the service value. To improve the environmental performance of enterprises, to the important role in understanding, have started the construction of reverse logistics system. Compared with the western developed countries, the level of development of reverse logistics in China is still very backward, many social and environmental problems remain to be solved. In order to promote the development of reverse logistics in China, this article from the perfect laws and regulations of the reverse logistics point of view, mainly divided into the following parts: the first part, based on lots of literatures, the concept and characteristics of reverse logistics are related Introduced, and combined with the current development of reverse logistics industry in China, analyzes the shortcomings of reverse logistics laws and regulations. In the second part, this article from the legal principle of legislative mode, legal system, three aspects, combined with Germany, the United States and Japan, the existing laws and regulations of reverse logistics, analyzes the advanced experience and Enlightenment of the lead in the world the third part, this article from the theoretical foundation of environmental protection, circular economy and sustainable development, put forward to perfect the laws and regulations on the one hand, the reverse logistics will continue to promote economic development, protect the environment and conserve resources combination principle, on the other hand to uphold the forward-looking and benefit balance principle. Finally, this paper puts forward the sound a series of measures, the construction of reverse logistics legal system include: first of all, we must accurately to subject and object definition, provide premise for the orderly development of reverse logistics activities To define the subject of reverse logistics; secondly the legal responsibility, not only to regulate corporate responsibility, but also integrate the government and consumers of the two, play an irreplaceable role; at the same time, in the face of China's legislation and current situation of reverse logistics decentralized low operation, our country should as soon as possible for the corresponding implementation details, enhance its operation; finally, from two aspects of supervision mechanism and incentive mechanism, perfect the laws and regulations of reverse logistics are summarized the induction.
