基于旅游法的河南省旅游購(gòu)物環(huán)境研究

【摘要】:旅游業(yè)作為一個(gè)新興的產(chǎn)業(yè),雖然起步較晚,但隨著國(guó)民經(jīng)濟(jì)的快速發(fā)展和運(yùn)行,旅游業(yè)以其獨(dú)特的生命力和發(fā)展?jié)摿焖傧蚯鞍l(fā)展,取得的經(jīng)濟(jì)效益日益增強(qiáng)。旅游購(gòu)物作為旅游的一個(gè)體驗(yàn)環(huán)節(jié),其購(gòu)物過(guò)程的愉悅程度將會(huì)影響旅游者對(duì)整個(gè)旅游過(guò)程的評(píng)價(jià),甚至?xí)绊懙铰糜握邔?duì)旅游目的地形象的客觀評(píng)價(jià)。河南省作為一個(gè)旅游資源大省,旅游商品種類(lèi)豐富,但是河南省的旅游購(gòu)物消費(fèi)在整個(gè)旅游消費(fèi)中一直處于較低的水平,遠(yuǎn)遠(yuǎn)不及景區(qū)的門(mén)票、旅游餐飲和住宿的收入,并且有相當(dāng)一部分旅游者對(duì)旅游購(gòu)物整體感覺(jué)不滿(mǎn)。造成這類(lèi)現(xiàn)象的原因有很多,其中旅游購(gòu)物環(huán)境差是造成旅游者不滿(mǎn)的一個(gè)主要原因。 在2013年10月1日《旅游法》頒布并實(shí)施后,在法律條文中明確規(guī)定了旅行社不得通過(guò)向游客安排購(gòu)物或者增加自費(fèi)項(xiàng)目來(lái)獲取一些不正當(dāng)?shù)睦妫瑫r(shí)在旅游行程中不能指定具體購(gòu)物場(chǎng)所。隨著《旅游法》的實(shí)施,給中國(guó)旅游業(yè)的發(fā)展帶來(lái)了新的希望和保障,同時(shí)在各地也引起了很大的反響,旅行社產(chǎn)品全面調(diào)整,購(gòu)物線(xiàn)路和購(gòu)物點(diǎn)都從旅游線(xiàn)路中大幅度的刪除,對(duì)于河南省這類(lèi)本身旅游購(gòu)物收入比重占整個(gè)旅游收入比重都較小的區(qū)域來(lái)說(shuō),旅游購(gòu)物的發(fā)展更是雪上加霜。在當(dāng)下的旅游大環(huán)境下,我們必須充分認(rèn)識(shí)到,如何依據(jù)《旅游法》的規(guī)定,規(guī)范旅游行程,同時(shí)在不影響旅游者旅游的過(guò)程下提高旅游者的購(gòu)物消費(fèi),增加旅游收入。 通過(guò)相關(guān)研究發(fā)現(xiàn),關(guān)于旅游購(gòu)物環(huán)境的研究很少,,并且一般都是對(duì)旅游購(gòu)物的構(gòu)成進(jìn)行分析。在已往研究的基礎(chǔ)上,本文提出了以旅游業(yè)發(fā)展中旅游購(gòu)物環(huán)境的依法建設(shè)和管理作為研究對(duì)象,通過(guò)調(diào)研分析了河南省旅游購(gòu)物環(huán)境存在的問(wèn)題,并就此提出解決問(wèn)題的對(duì)策。文章首先針對(duì)旅游業(yè)法律體系建設(shè)在對(duì)國(guó)內(nèi)外旅游業(yè)的影響進(jìn)行研究分析,利用文獻(xiàn)研究和調(diào)研相結(jié)合的方法,借鑒國(guó)內(nèi)外的先進(jìn)經(jīng)驗(yàn),結(jié)合河南省獨(dú)特區(qū)域的旅游購(gòu)物環(huán)境進(jìn)行分析。其次,研究《旅游法》在旅游業(yè)中的作用和發(fā)展,本文從法律角度對(duì)旅游業(yè)的主要影響進(jìn)行解釋《旅游法》在旅游業(yè)中的作用,針對(duì)河南進(jìn)行實(shí)證分析,引用法律法規(guī),以促進(jìn)河南省旅游購(gòu)物環(huán)境在法律的監(jiān)管下得到完善發(fā)展。最后總結(jié)并針對(duì)研究的問(wèn)題提出相應(yīng)的應(yīng)對(duì)舉措,在《旅游法》法律的監(jiān)管下,提出能夠?qū)τ诤幽鲜∩踔寥珖?guó)具有一定影響力的適應(yīng)旅游者購(gòu)物需求的良好旅游購(gòu)物環(huán)境,增加地方的旅游購(gòu)物消費(fèi)和旅游收入。以期通過(guò)本文的研究,能為地方建立健全旅游購(gòu)物相關(guān)的法律法規(guī)提供參考依據(jù),為構(gòu)建完美的旅游購(gòu)物環(huán)境的建設(shè),穩(wěn)定和可持續(xù)發(fā)展提供重要保證。
[Abstract]:Tourism as a new industry, although starting late, but with the rapid development and operation of the national economy, tourism with its unique vitality and development potential rapid development, the economic benefits are increasingly enhanced. Tourism shopping as an experiential link of tourism, the degree of pleasure of its shopping process will affect the tourists' evaluation of the whole tourism process, and even affect the tourists' objective evaluation of the image of the tourist destination. Henan Province, as a province with large tourism resources, has a rich variety of tourist commodities. However, the consumption of tourism shopping in Henan Province has been at a relatively low level in the whole tourism consumption, which is far less than the income of tickets, tourist catering and accommodation in scenic spots. And there are quite a number of tourists to travel shopping overall feeling dissatisfied. There are many reasons for this phenomenon, among which poor tourist shopping environment is one of the main reasons for tourist dissatisfaction. Following the promulgation and implementation of the Tourism Law on October 1, 2013, the law explicitly stipulates that travel agencies are not allowed to obtain undue benefits by arranging shopping or increasing self-financing items from tourists. At the same time in the travel itinerary cannot specify the specific shopping place. With the implementation of the "Tourism Law", it has brought new hopes and guarantees to the development of China's tourism industry. At the same time, it has also caused great repercussions in various places. The products of travel agencies have been comprehensively adjusted. Shopping routes and shopping points are removed from the tourist routes by a large margin. The development of tourism shopping in Henan Province, where the proportion of tourism shopping income is small, is even worse. In the current tourism environment, we must fully realize how to regulate the travel schedule according to the regulations of "Tourism Law", and at the same time, increase the tourists' shopping consumption and tourism income in the process of not affecting the tourists' tourism. It is found that there are few researches on tourism shopping environment, and the composition of tourism shopping is generally analyzed. On the basis of the previous research, this paper takes the legal construction and management of tourist shopping environment in the development of tourism industry as the research object, and analyzes the problems existing in the tourist shopping environment of Henan Province through investigation and analysis. And put forward the solution to the problem. Firstly, the paper analyzes the impact of the legal system construction of tourism on the tourism industry at home and abroad, and uses the method of combining literature research and research to learn from the advanced experience at home and abroad. Combined with the unique area of Henan Province tourism shopping environment analysis. Secondly, the paper studies the role and development of Tourism Law in tourism industry. This paper explains the main impact of Tourism Law on tourism industry from the angle of law, analyzes the role of Tourism Law in tourism industry from the perspective of laws and regulations, and makes an empirical analysis on Henan Province, citing laws and regulations. In order to promote Henan Province tourism shopping environment under the supervision of the law to improve the development. Finally, the author summarizes and puts forward corresponding measures to deal with the problems studied. Under the supervision of the "Tourism Law", it puts forward a good tourist shopping environment which can have certain influence on Henan Province and even the whole country to meet the needs of tourists' shopping. Increase local tourism shopping consumption and tourism income. Through the study of this paper, it can provide reference for the establishment and improvement of local laws and regulations related to tourism shopping, and provide an important guarantee for the construction of a perfect tourist shopping environment, stability and sustainable development.
