【摘要】：《反恐怖主義法》是我國第一部專門打擊恐怖主義的立法,它基于21世紀(jì)以來恐怖主義活動日益猖獗的現(xiàn)狀,借鑒了國際反恐怖主義立法的先進(jìn)之處,體現(xiàn)了預(yù)防性打擊恐怖主義與人權(quán)保障的立法原則,是我國反恐邁出的重要一步。此次立法首次創(chuàng)設(shè)了"安置教育"制度,它是我國反恐立法的一次突破,為根治恐怖主義思想毒瘤提供了特殊程序保障。但"安置教育"制度存在著實(shí)施機(jī)構(gòu)模糊、具體措施缺乏、評估間隔太長等問題,需要進(jìn)一步明確它的實(shí)施主體與具體措施,以保證制度的實(shí)施效果,有效預(yù)防恐怖主義活動的蔓延。
[Abstract]:The Anti-terrorism Law is the first legislation specializing in combating terrorism in our country. It is based on the increasingly rampant terrorist activities since the 21st century, draws lessons from the advances of international anti-terrorism legislation, embodies the legislative principles of preventive fight against terrorism and human rights protection, and is an important step against terrorism in our country. This legislation has created the "placement education" system for the first time, which is a breakthrough in the anti-terrorism legislation of our country, and provides a special procedural guarantee for the eradication of terrorist ideological cancer. However, there are some problems in the "placement education" system, such as vague implementation institutions, lack of specific measures, long evaluation interval and so on. It is necessary to further clarify its implementation subject and specific measures in order to ensure the implementation effect of the system and effectively prevent the spread of terrorist activities.
