我國野生稻資源保護(hù)法律制度研究

【摘要】：野生稻資源是重要的農(nóng)業(yè)種質(zhì)資源和遺傳多樣性資源,對于維持生物多樣性和水稻育種研究具有重要的作用,是我國重要的戰(zhàn)略資源,關(guān)系著國家的糧食安全,對野生稻資源的保護(hù)具有舉足輕重的作用。但是在野生稻資源的保護(hù)方面存在一些問題。本文共有四個(gè)部分:第一部分介紹了野生稻資源保護(hù)的價(jià)值及其在我國的瀕危狀況,野生稻資源的保護(hù)價(jià)值主要從野生稻資源是國家糧食安全的重要保證、改良水稻品質(zhì)提高人民生活水平、生物多樣性保護(hù)的需要進(jìn)行介紹:野生稻的瀕危狀況主要從我國野生稻資源的主要種類、面積、生長地區(qū)、面積和種類的劇減等方面進(jìn)行闡述,充分說明了我國野生稻資源的保護(hù)迫在眉睫。第二部分寫我國野生稻資源保護(hù)法律制度的現(xiàn)狀及缺陷;野生稻資源保護(hù)的立法現(xiàn)狀主要將我國野生植物保護(hù)的法律制度進(jìn)行了相關(guān)的介紹;缺陷主要介紹了野生稻資源惠益共享制度方面存在不完善;原生境和保護(hù)區(qū)保護(hù)不力;缺乏專門的立法;野生稻資源保護(hù)級別低;法律責(zé)任不完善主要從違法成本低、處罰尺度不明晰、處罰類型單一等方面進(jìn)行闡述;獎(jiǎng)勵(lì)制度可操作性不強(qiáng);行政執(zhí)法力量薄弱;行政管理體制不完善主要從各部門分割嚴(yán)重協(xié)調(diào)性差、多頭管理、監(jiān)管職責(zé)不明確等方面進(jìn)行相關(guān)的闡述;缺乏野生稻補(bǔ)償機(jī)制等。第三部分主要介紹野生稻資源保護(hù)的國外立法及借鑒,主要介紹了美國、英國、印度、巴西等國的立法,并且從中總結(jié)出對我國野生稻資源保護(hù)的借鑒之處是我國應(yīng)完善立法、完善管理體制、加強(qiáng)公眾參與,以實(shí)現(xiàn)對野生稻資源的切實(shí)保護(hù)。第四部主要針對我國野生稻資源保護(hù)法律制度出現(xiàn)的問題而提出的對策和建議。主要包括制定《野生稻資源保護(hù)條例》;完善野生稻資源的獲得制度和惠益共享制度;加強(qiáng)對原生境和自然保護(hù)區(qū)的管理與保護(hù);建立野生稻自然保護(hù)區(qū);提高野生稻資源的保護(hù)級別;建立完善的資金保障制度;完善法律責(zé)任;完善野生稻保護(hù)激勵(lì)機(jī)制;完善野生稻保護(hù)補(bǔ)償機(jī)制;完善行政管理體制;建立野生稻種質(zhì)資源庫和信息庫等對策。
[Abstract]:Wild rice resource is an important agricultural germplasm resource and genetic diversity resource, plays an important role in maintaining biodiversity and rice breeding research, is an important strategic resource in China, and is related to the national food security. It plays an important role in the protection of wild rice resources. However, there are some problems in the protection of wild rice resources. There are four parts in this paper: the first part introduces the value of wild rice resources conservation and its endangered status in China. The protection value of wild rice resources mainly from wild rice resources is an important guarantee of national food security. To improve the quality of rice and improve the living standard of the people, the need of biodiversity conservation is introduced. The endangered status of wild rice is mainly from the main species, area and growing area of wild rice resources in China. The dramatic decrease of area and species shows that the protection of wild rice resources in China is urgent. The second part is about the current situation and defects of the legal system of wild rice resources protection in China, and the legislation status of wild rice resources protection mainly introduces the legal system of wild rice resources protection in China. The defects mainly introduced the imperfect benefit sharing system of wild rice resources; the weak protection of original habitats and protected areas; the lack of special legislation; the low level of wild rice resources protection; The legal liability is not perfect mainly from the low illegal cost, the unclear punishment scale, the single punishment type and other aspects; the reward system is not operational; the administrative law enforcement power is weak; The imperfect administrative management system mainly from the division of various departments serious poor coordination, multi-head management, unclear regulatory responsibilities and other aspects of related elaboration; lack of compensation mechanism for wild rice, and so on. The third part mainly introduces the foreign legislation and reference of the protection of wild rice resources, mainly introduces the legislation of the United States, Britain, India, Brazil and other countries, and summarizes the reference to the conservation of wild rice resources in China is that China should perfect the legislation. Improve the management system and strengthen public participation in order to achieve the effective protection of wild rice resources. The fourth part is mainly aimed at the problems in the legal system of conservation of wild rice resources in China and puts forward some countermeasures and suggestions. It mainly includes formulating the regulations on the Conservation of Wild Rice Resources, perfecting the access system and benefit sharing system of Wild Rice Resources, strengthening the management and protection of the original habitat and nature reserve, establishing the Wild Rice Nature Reserve, establishing the wild rice nature reserve, and strengthening the management and protection of original habitat and nature reserve. Improve the protection level of wild rice resources; establish a perfect fund security system; perfect the legal responsibility; perfect the incentive mechanism of wild rice protection; perfect the protection compensation mechanism of wild rice; perfect the administrative management system; Establishment of wild rice germplasm resources database and information database and other countermeasures.
