論汽車限牌制度

【摘要】:論文通過(guò)對(duì)上海、北京、貴陽(yáng)、廣州、天津等城市先后出臺(tái)的汽車限牌制度進(jìn)行研究,分析政府以公共利益為基礎(chǔ)的前提下,通過(guò)制定地方性法規(guī)調(diào)節(jié)公共資源配置的合法性問(wèn)題。強(qiáng)調(diào)各級(jí)政府在制定相關(guān)政策和法規(guī)的過(guò)程中,必須做到有法可依、有法必依、執(zhí)法必嚴(yán)、違法必究,應(yīng)該從法律和制度上限制政府權(quán)力,防止公權(quán)力的無(wú)限擴(kuò)大甚至濫用,保障公民的合法權(quán)益不受侵害。論文通過(guò)分析認(rèn)為,汽車限牌制度的內(nèi)容和形式均導(dǎo)致了很多負(fù)面示范效應(yīng),其產(chǎn)生過(guò)程存在不符合正當(dāng)法律程序等問(wèn)題,,實(shí)施結(jié)果更是造成了新的社會(huì)不公,在利益考量上也存在著嚴(yán)重的“法益”失衡現(xiàn)象。論文主張廢止現(xiàn)有的汽車限牌制度,通過(guò)采取更加合理可行的其他替代性措施解決交通擁堵問(wèn)題,具體包括實(shí)行車輛限行、發(fā)展城市公共交通、擴(kuò)建城市道路、提倡低碳環(huán)保出行等。
[Abstract]:Through the research on the automobile license restriction system introduced successively in Shanghai, Beijing, Guiyang, Guangzhou, Tianjin and other cities, the paper analyzes the government's public interest-based premise. Through the formulation of local laws and regulations to regulate the legitimacy of the allocation of public resources. Emphasizing that in the process of formulating relevant policies and regulations, governments at all levels must have laws to comply with, have laws to abide by, enforce laws strictly, and be held accountable for violations of the law, and should restrict government power by law and system, and prevent the unlimited expansion or even abuse of public power, To protect the legitimate rights and interests of citizens from being infringed. Through the analysis, the paper thinks that the contents and forms of the automobile license restriction system have caused a lot of negative demonstration effects, and there are some problems in the process of its emergence, such as not conforming to the due process of law, and the result of its implementation has resulted in new social injustices. There is also a serious imbalance of legal interests in the consideration of interests. The thesis advocates abolishing the existing system of car license restriction and solving the problem of traffic congestion by taking more reasonable and feasible alternative measures, including the implementation of traffic restrictions, the development of urban public transport, and the expansion of urban roads.
