【摘要】：隨著我國行政民主化的快速提升，公眾參與成為衡量行政決策科學性的一個重要指標。本文從公眾參與、行政決策的概念著手，通過對比大陸法系與英美法系行政法學不同來介紹美國、英國、德國的公眾參與行政決策的發(fā)展概況，，在一定程度上對西方國家的公眾參與理論加以了解。隨后開始從政策、法律、實踐層面概括出我國行政決策中公眾參與發(fā)展現(xiàn)狀并介紹現(xiàn)行法律中公眾參與行政決策的三種常見形式，以及從流程的角度上分析各各程序階段的公眾參與。分析其存在的合法性與正當性，從根本上為我國行政決策中的公眾參與制度提供支持。雖然我國一直在進行公眾參與行政決策相關的實踐探索，并取得巨大進步，但是，當前我國公眾參行政決策仍然存在著政治參與意識淡薄、參與主體不明確、參與度不高、參與信息缺乏、以及參與意見得不到反饋等五個方面問題。針對上述情況，本文從系統(tǒng)的角度，提出以下可行性措施進行完善：樹立行政決策的民主化、科學化的理念、加強公眾參與行政決策的載體建設以及建立與完善公眾參與行政決策的相關制度。
[Abstract]:With the rapid promotion of administrative democratization in China, public participation has become an important indicator to measure the scientific nature of administrative decision-making. From the concept of public participation and administrative decision-making, this paper introduces the development of public participation in administrative decision-making in the United States, Britain and Germany by comparing the differences between the civil law system and the common law system. To some extent, to understand the theory of public participation in western countries. Then, from the aspects of policy, law and practice, it generalizes the current situation of public participation in administrative decision-making and introduces three common forms of public participation in administrative decision-making. And from the point of view of the process of analysis of the various stages of the process of public participation. This paper analyzes the legitimacy and legitimacy of its existence and provides support for the system of public participation in administrative decision making in our country. Although our country has been carrying on the practice exploration related to the public participation in administrative decision-making, and has made great progress, but at present, there is still a weak sense of political participation, the participation of the main body is not clear, the degree of participation is not high. There are five problems, such as the lack of information and the lack of feedback. In view of the above situation, this paper puts forward the following feasible measures from a systematic point of view: to establish the idea of democratization and scientization of administrative decision making, Strengthen the carrier construction of public participation in administrative decision-making and establish and perfect the relevant system of public participation in administrative decision-making.
