【摘要】：正黨的十八屆四中全會作出了全面推進依法治國的重大戰(zhàn)略部署,描繪了法治中國建設的宏偉藍圖。在依法治國理念的指導下,作為依法治國基本內(nèi)容的檔案工作也必須把依法治檔作為工作原則和發(fā)展方向。1987年9月5日《中華人民共和國檔案法》正式頒布,標志著我國檔案工作步入了法制化軌道。與之相配套的《檔案法實施辦法》《檔案行政處罰程序暫行規(guī)定》《檔案管理違法違紀行為處分規(guī)定》等一系列檔案行政法規(guī)、檔案行政規(guī)章的陸續(xù)出臺,形成了比較完善的檔案法律、法規(guī)體系,保證了我國檔案事業(yè)有法可依。然而,從目前檔案執(zhí)法過程中可以發(fā)現(xiàn),多數(shù)情況下依法治檔的效果
[Abstract]:The fourth Plenary session of the 18th CPC Central Committee made a major strategic plan to comprehensively promote the rule of law and drew a grand blueprint for the construction of China under the rule of law. Under the guidance of the concept of governing the country according to law, the archival work, which is the basic content of governing the country by law, must also take the management of archives according to law as the working principle and the direction of development.On September 5, 1987, the Archives Law of the people's Republic of China was formally promulgated. Marks our country archives work to step into the legal orbit. A series of archives administrative laws and regulations, such as the "measures for the implementation of the Archives Law" and the "interim provisions on the procedures for archival Administrative punishment" and the provisions on the punishment of illegal and Disciplinary violations of Archives Management, have been promulgated one after another. Formed a relatively perfect archives laws and regulations system, to ensure that the cause of archives in China have laws to abide by. However, from the current law enforcement process of archives, we can find that in most cases, the effect of managing files according to law can be found.
