【摘要】：正旅游用地的概念,最早出現(xiàn)于1990年國務(wù)院頒布的《城鎮(zhèn)國有土地使用權(quán)出讓和轉(zhuǎn)讓暫行條例》,其中明確指出商業(yè)、旅游、娛樂用地土地使用權(quán)出讓最高年限40年。在《土地管理法》中,建設(shè)用地也涵蓋了旅游用地。2002年,國土資源部發(fā)布的《招標(biāo)拍賣掛牌出讓國有土地使用權(quán)規(guī)定》又特別明確了"商業(yè)、旅游、娛樂和商品住宅等各類經(jīng)營性用地,必須以招標(biāo)、拍賣或者掛牌方式出讓"。盡管在我國現(xiàn)行法律和規(guī)定中都
