【摘要】：近十年來,頻繁發(fā)生的各國食品安全事件,使得食品安全問題成為世界性的熱點(diǎn)問題,食品召回法律制度作為食品安全監(jiān)管體系的重要組成部分也受到了人們的密切關(guān)注。作為缺陷產(chǎn)品召回范疇中的食品召回,是一種預(yù)防性措施,其主要為了在不安全食品對消費(fèi)者造成實(shí)際危害前對其進(jìn)行收回,以避免或減少不安全食品對人體健康的危害。 食品召回制度是20世紀(jì)60年代最早在美國建立的,隨后加拿大、澳大利亞、英國等許多西方國家也分別建立了食品召回制度。我國的食品召回制度確立較晚,體系尚不夠完善,在許多環(huán)節(jié)仍不夠成熟。然而現(xiàn)階段我國食品安全狀況不容樂觀,重大食品安全事故時(shí)有發(fā)生,作為食品安全監(jiān)管的最后一道防線,加快建設(shè)和完善我國的食品召回法律制度是實(shí)屬必然。 本文從食品召回法律制度的概念入手,在對食品召回制度的理論依據(jù)和現(xiàn)實(shí)需求進(jìn)行解析的基礎(chǔ)上,指出我國食品召回制度的現(xiàn)狀并進(jìn)行原因分析,然后對西方發(fā)達(dá)國家的食品召回制度進(jìn)行借鑒,結(jié)合我國國情的基礎(chǔ)上,對我國食品召回制度的完善提出建議。
[Abstract]:In the past ten years, the frequent food safety incidents in various countries have made the food safety problems become a worldwide hot issue. As an important part of the food safety supervision system, the legal system of food recall has also been paid close attention to. As a kind of food recall in defective product recall, it is a kind of preventive measure, which mainly aims to recover unsafe food before it causes actual harm to consumers, in order to avoid or reduce the harm to human health caused by unsafe food. The food recall system was first established in the United States in the 1960s. Subsequently, many western countries, such as Canada, Australia, Britain and so on, also established the food recall system. China's food recall system was established late, the system is not perfect, in many links are still not mature. However, the current situation of food safety in China is not optimistic, major food safety accidents occur from time to time, as the last line of defense of food safety supervision, it is inevitable to speed up the construction and improvement of the legal system of food recall in our country. Starting with the concept of food recall legal system and analyzing the theoretical basis and practical demand of food recall system, this paper points out the current situation of food recall system in China and analyzes the reasons for it. Then the food recall system of the western developed countries is used for reference, and based on the national conditions of our country, some suggestions are put forward to improve the food recall system in our country.
