我國食品召回法律制度研究
[Abstract]:In the past ten years, the frequent food safety incidents in various countries have made the food safety problems become a worldwide hot issue. As an important part of the food safety supervision system, the legal system of food recall has also been paid close attention to. As a kind of food recall in defective product recall, it is a kind of preventive measure, which mainly aims to recover unsafe food before it causes actual harm to consumers, in order to avoid or reduce the harm to human health caused by unsafe food. The food recall system was first established in the United States in the 1960s. Subsequently, many western countries, such as Canada, Australia, Britain and so on, also established the food recall system. China's food recall system was established late, the system is not perfect, in many links are still not mature. However, the current situation of food safety in China is not optimistic, major food safety accidents occur from time to time, as the last line of defense of food safety supervision, it is inevitable to speed up the construction and improvement of the legal system of food recall in our country. Starting with the concept of food recall legal system and analyzing the theoretical basis and practical demand of food recall system, this paper points out the current situation of food recall system in China and analyzes the reasons for it. Then the food recall system of the western developed countries is used for reference, and based on the national conditions of our country, some suggestions are put forward to improve the food recall system in our country.
