【摘要】：本研究以行政協(xié)議的正式入法為契機,在對現(xiàn)有學說和質疑進行回應的基礎上,提出了建立行政協(xié)議相對方義務強制執(zhí)行制度。文中通過對行政協(xié)議相關法律文件和司法案例的梳理,歸納出主要的行政協(xié)議種類,進而對行政協(xié)議相對方義務強制執(zhí)行權的分配進行探討,為解決行政協(xié)議相對方義務履行困境提供了路徑。
[Abstract]:Taking the formal entry of administrative agreement as the turning point and responding to the existing theories and doubts, this study puts forward the establishment of the system of enforcement of the party's obligations under the administrative agreement. By combing the relevant legal documents and judicial cases of administrative agreement, this paper summarizes the main types of administrative agreement, and then discusses the distribution of the right of enforcement of the party's obligation to the administrative agreement. In order to solve the administrative agreement relative party obligations to fulfill the dilemma provided a path.
