【摘要】：2007年4月,國務院頒布了《中華人民共和國政府信息公開條例》,并于次年5月1日始正式實施。揆諸世界各國如美、英、日等國的《信息自由法》可以發(fā)現(xiàn),中外對于政府信息公開立法中公開范圍的制度設計可謂大異其趣。這種迥異是立法理念與原則的產物,由此也導致了自《條例》實施數(shù)年來政府信息公開的執(zhí)行情況仍然不盡如人意的效果與結果。我們以為,問題解決的關鍵還需遵從現(xiàn)代政府信息公開立法的一般法理,重塑并重構政府信息公開立法理念與理論,從而實現(xiàn)從"知的需求"到"知的權利"的制度轉型與跨越。本文還就《中華人民共和國檔案法》第一條的修改談了一些個人看法。
[Abstract]:In April 2007, the State Council promulgated the regulations of the people's Republic of China on the publicity of Government Information, which came into effect on May 1 of the following year. The "Freedom of Information Law" in countries such as the United States, Britain, Japan and other countries in the world can be found that the system design of the scope of disclosure in the legislation of government information disclosure at home and abroad is quite different. This difference is the product of the legislative ideas and principles, which has led to the implementation of the "regulations" since the implementation of the government information disclosure for several years still unsatisfactory results and results. We think that the key to solve the problem is to conform to the general legal principle of modern government information disclosure legislation, to reshape and reconstruct the legislative idea and theory of government information disclosure. In order to realize the system transition from "need of knowledge" to "right of knowledge". This paper also gives some personal opinions on the amendment of Article 1 of the Archives Law of the people's Republic of China.
