【摘要】：海綿城市建設(shè)主要為了解決水資源短缺,水環(huán)境污染以及水安全等方面的問(wèn)題,環(huán)保領(lǐng)域力推PPP模式已不是新鮮話題,我國(guó)各地政府大力發(fā)展海綿城市試點(diǎn)工作的過(guò)程中也不斷將PPP模式納入到項(xiàng)目建設(shè)中來(lái)。但從海綿城市PPP項(xiàng)目實(shí)踐情況來(lái)看,諸多問(wèn)題不斷凸顯,亟待解決。本文主要介紹了國(guó)內(nèi)外PPP模式以及海綿城市建設(shè)的實(shí)踐和研究現(xiàn)狀,從法學(xué)角度以海綿城市建設(shè)PPP模式的法律關(guān)系為主進(jìn)行了分析,提出了我國(guó)海綿城市建設(shè)PPP模式的法律關(guān)系中存在的問(wèn)題,并給出了相應(yīng)的完善建議。第一部分主要介紹了海綿城市建設(shè)PPP模式的國(guó)內(nèi)外實(shí)踐現(xiàn)狀,分別介紹了英國(guó)、美國(guó)、日本、加拿大的海綿城市建設(shè)PPP模式實(shí)踐情況以及我國(guó)的實(shí)踐歷程和立法現(xiàn)狀,以此展開(kāi)對(duì)海綿城市建設(shè)PPP模式的法律關(guān)系問(wèn)題的研究。第二部分主要介紹了海綿城市建設(shè)PPP模式的基本內(nèi)涵、類(lèi)型、特點(diǎn)以及理論基礎(chǔ)。通過(guò)對(duì)海綿城市PPP模式的基本內(nèi)涵和類(lèi)型的闡述,明確了對(duì)研究對(duì)象的基本認(rèn)識(shí);對(duì)海綿城市PPP模式同普通PPP模式的比較,突出體現(xiàn)了海綿城市建設(shè)PPP模式自身的特點(diǎn);對(duì)海綿城市PPP模式相關(guān)理論的分析,促進(jìn)了該研究主題在環(huán)境法學(xué)上的基礎(chǔ)應(yīng)用作用。第三部分主要是對(duì)海綿城市建設(shè)PPP模式的法律關(guān)系進(jìn)行分析。該部分主要介紹了海綿城市PPP項(xiàng)目的主體以及對(duì)主體的法律關(guān)系性質(zhì)進(jìn)行了梳理,進(jìn)而對(duì)主體的權(quán)利義務(wù)進(jìn)行分析,其中通過(guò)對(duì)江蘇鎮(zhèn)江和云南玉溪的實(shí)踐案例的介紹,直觀的分析了海綿城市PPP項(xiàng)目的法律關(guān)系性質(zhì)和權(quán)利義務(wù)的關(guān)系。第四部分提出了海綿城市建設(shè)PPP模式的法律合同中,各主體以及各參與者之間的權(quán)利義務(wù)設(shè)置存在的問(wèn)題。并結(jié)合我國(guó)的實(shí)踐,對(duì)參與主體和權(quán)利義務(wù)設(shè)置凸顯的法律問(wèn)題及原因進(jìn)行了分析,同時(shí)對(duì)PPP項(xiàng)目合同類(lèi)型的選擇出現(xiàn)的阻礙進(jìn)行了介紹。第五部分對(duì)海綿城市建設(shè)PPP模式的法律關(guān)系中存在的問(wèn)題給出相應(yīng)的完善建議和解決措施,力求能夠?yàn)镻PP模式下的海綿城市建設(shè)提供一些法律制度上的參考和問(wèn)題完善方面的借鑒。
[Abstract]:Sponge city construction is mainly to solve the problems of water shortage, water environment pollution and water safety, etc. It is no longer a new topic to push the PPP model in the field of environmental protection. In the process of developing Sponge City pilot project, the local governments of our country have constantly incorporated the PPP model into the project construction. But from the sponge city PPP project practice, many problems continue to highlight, urgent need to be solved. This paper mainly introduces the PPP model at home and abroad as well as the practice and research status of sponge city construction, and analyzes the legal relationship of sponge city construction PPP model from the angle of law. This paper puts forward the problems existing in the legal relationship of the PPP model of sponge city construction in China, and puts forward some corresponding suggestions for perfection. The first part mainly introduces the domestic and international practice status of sponge city construction PPP model, introduces the practice of sponge city construction PPP model in Britain, the United States, Japan and Canada, as well as the practice course and legislation status of our country. Based on this, the study on the legal relationship of sponge city construction PPP model. The second part mainly introduces the basic connotation, types, characteristics and theoretical basis of sponge city construction PPP model. By expounding the basic connotation and types of sponge city PPP model, the author makes clear the basic understanding of the research object, compares the sponge city PPP model with the ordinary PPP model, and highlights the characteristics of the sponge city construction PPP model. The analysis of the theory of sponge city PPP model promotes the basic application of this research topic in environmental law. The third part mainly analyzes the legal relationship of sponge city construction PPP model. This part mainly introduces the main body of the sponge city PPP project and the nature of the legal relationship of the subject, and then analyzes the rights and obligations of the subject, including the practical cases of Zhenjiang in Jiangsu Province and Yuxi in Yunnan Province. Intuitively analyzed the sponge city PPP project legal relations nature and the rights and obligations relations. The fourth part puts forward the problems of the rights and obligations between the subjects and participants in the legal contract of sponge city construction PPP model. Combined with the practice of our country, this paper analyzes the legal problems and reasons of the main body of participation and the setting of rights and obligations, and introduces the obstacles in the choice of contract type of PPP project. In the fifth part, the author gives some suggestions and solutions to the problems existing in the legal relationship of sponge city construction PPP model. This paper tries to provide some reference for the construction of sponge city under PPP mode.
