國外校園欺凌立法治理體系:現(xiàn)狀、特點與借鑒——基于七個發(fā)達國家的比較分析

【摘要】:美國、英國、澳大利亞、瑞典、挪威、日本和韓國等發(fā)達國家在校園欺凌國家立法、地方立法、政策措施、項目實施等方面積累了成功經(jīng)驗。七個發(fā)達國家校園欺凌治理體系的特點主要體現(xiàn)在:法制體系完善;適應(yīng)形勢變化,不斷修改舊法,頒布新法;重視校園欺凌問題的調(diào)查和研究,為完善制度體系提供決策信息;強化各方職責(zé),注重過程監(jiān)控,對校園欺凌"零容忍";搭建各種防治校園欺凌平臺,治理校園欺凌"不留死角"和注重對網(wǎng)絡(luò)欺凌的治理。我國校園欺凌治理的制度建設(shè)還存在諸多不足,這七個發(fā)達國家的立法治理體系可為我國處理校園欺凌提供重要參考。
[Abstract]:Developed countries such as the United States, Britain, Australia, Sweden, Norway, Japan and South Korea have accumulated successful experience in school bullying national legislation, local legislation, policy measures, project implementation and so on. The characteristics of campus bullying governance system in seven developed countries are as follows: perfect legal system, adapt to the changing situation, constantly revise old laws and promulgate new laws; Pay attention to the investigation and research of campus bullying, provide decision-making information for perfecting the system, strengthen the responsibilities of all parties, pay attention to process monitoring, and "zero tolerance" to campus bullying; Build various prevention and cure campus bullying platform, control campus bullying "do not leave the corner" and focus on the governance of cyberbullying. There are still many deficiencies in the system construction of campus bullying governance in China. The legislative governance system of these seven developed countries can provide an important reference for our country to deal with campus bullying.
