機(jī)動車尾號限行法律規(guī)制研究

【摘要】:本文探討的機(jī)動車尾號限行是是政府部門對公共交通安全進(jìn)行管理的一項(xiàng)行政職權(quán)。隨著社會經(jīng)濟(jì)的不斷發(fā)展,我國居民的生活水平也比之前有了很大的改善,私家車數(shù)量變得越來越多,城市道路交通狀況因此變得越來越糟糕,,特別是對北京、重慶、武漢等大城市來說,其交通擁堵現(xiàn)象十分嚴(yán)重。為了解決交通擁堵問題,部分城市的政府部門相繼出臺了機(jī)動車尾號限行等政策,尾號限行是一種行政強(qiáng)制措施,該措施在疏導(dǎo)交通、改善道路交通的通行秩序等方面起到了積極的作用。不過在實(shí)際操作過程以及理論方面,尾號限行措施還存在一定的不足,需要進(jìn)一步去完善。本文在分析機(jī)動車尾號限行政策的實(shí)施現(xiàn)狀基礎(chǔ)上,針對其存在的問題進(jìn)行了探討,重點(diǎn)探討了機(jī)動車尾號限行的法律規(guī)制,提出了法律規(guī)制的幾點(diǎn)構(gòu)想。本文主要分為以下五個部分: 第一部分是緒論,主要介紹了本文的研究目的、研究意義以及國內(nèi)外關(guān)于機(jī)動車尾號限行的研究現(xiàn)狀。 第二部分是機(jī)動車尾號限行法律規(guī)制的概述,具體介紹了機(jī)動車尾號限行的概念和特點(diǎn),此外,還對機(jī)動車尾號限行的必要性進(jìn)行了闡述。 第三部分是機(jī)動車尾號限行法律規(guī)制的不足,指出了我國機(jī)動車尾號限行的法律依據(jù)不足,正因?yàn)闆]有完善的法律制度來進(jìn)行規(guī)制,導(dǎo)致各地機(jī)動車尾號限行存在很多的問題。 第四部分依據(jù)我國的國情和機(jī)動車尾號限行工作所存在的問題,提出了有針對性的解決方案,并指出了通過法律來規(guī)制尾號限行的幾點(diǎn)構(gòu)想。 第五部分是結(jié)論,主要對本文的研究作了系統(tǒng)總結(jié),指出文中存的不足之處。
[Abstract]:The motor vehicle tail number restriction discussed in this paper is an administrative authority of the government department to manage the public traffic safety. With the continuous development of social economy, the living standards of Chinese residents have also been greatly improved, the number of private cars has become more and more, and the urban road traffic situation has become worse and worse, especially for Beijing and Chongqing. Wuhan and other big cities, its traffic congestion is very serious. In order to solve the problem of traffic congestion, government departments in some cities have successively introduced policies such as vehicle tail number restriction, which is an administrative compulsory measure to divert traffic. Improve the traffic order and other aspects of road traffic has played a positive role. But in the practical operation process and the theory aspect, the tail number limit measure also has the certain insufficiency, needs to be further consummated. Based on the analysis of the current situation of the implementation of the vehicle tail number restriction policy, this paper discusses the existing problems, focuses on the legal regulation of the motor vehicle tail number limit, and puts forward several ideas of the legal regulation. This paper is divided into the following five parts: the first part is the introduction, mainly introduces the purpose of this paper, the significance of the research and domestic and foreign research on motor vehicle tail number limit status. The second part is an overview of the legal regulation of the motor vehicle tail number restriction. The concept and characteristics of the vehicle tail number limit are introduced in detail. In addition, the necessity of the motor vehicle tail number restriction is also expounded. The third part is the insufficiency of the legal regulation of the motor vehicle tail number restriction, pointing out that the legal basis of the motor vehicle tail number limit in our country is insufficient, because there is no perfect legal system to regulate the motor vehicle tail number limit, there are a lot of problems in various places. In the fourth part, according to the situation of our country and the problems existing in the restriction of motor vehicle tail number, the author puts forward some targeted solutions, and points out some ideas of regulating the restriction of the end number by law. The fifth part is the conclusion, mainly makes the systematic summary to the research, points out the deficiency existing in this paper.
