【摘要】：隨著我國城市化水平的快速提升,農村征地問題引起的矛盾日益突出。在這一背景下,本文關注因征地引起的農民抗爭問題,引入制度適應理論模型,以北京市新機場征地拆遷為案例,分析由文本與環(huán)境二元分化所產生的沖突,從市場制度與集體主義、地方法規(guī)與村鎮(zhèn)具體環(huán)境兩個角度,深入挖掘中國以城市為主導的發(fā)展中存在的設計與實施的根本問題。解決這一問題,需要政府在符合法律規(guī)范的前提下,保障政策威信,調整具體策略,實現(xiàn)法律制度與農村現(xiàn)實情境的有效對接。
[Abstract]:With the rapid development of urbanization in China, the contradiction caused by the problem of land requisition in rural areas is becoming increasingly prominent. Under this background, this paper focuses on the problem of peasants' protest caused by land expropriation, introduces the theory model of institutional adaptation, and takes the land requisition and relocation of Beijing new airport as a case to analyze the conflict caused by the dualistic differentiation between text and environment. From the perspectives of market system and collectivism, local laws and regulations and the specific environment of villages and towns, this paper explores the fundamental problems in the design and implementation of China's city-oriented development. To solve this problem, it is necessary for the government to guarantee the prestige of the policy, adjust the specific strategy, and realize the effective connection between the legal system and the real situation in rural areas under the premise of conforming to the legal norms.
