【摘要】：正《中共中央關(guān)于全面推進(jìn)依法治國若干重大問題的決定》(以下簡稱《決定》)在"保證公正執(zhí)法,提高司法公信力"方面提出了諸多舉措,其中明確指出要加強(qiáng)對司法活動(dòng)的監(jiān)督,同時(shí)要求"規(guī)范媒體對案件的報(bào)道,防止輿論影響司法公正"。這一提法有著非常深刻的現(xiàn)實(shí)意義和指向,顯然《決定》對傳媒監(jiān)督權(quán)行使對司法活動(dòng)的監(jiān)督作用及其在法治社會(huì)中的多面向后果,有著非常清晰的把握。一、不當(dāng)行使傳媒監(jiān)督權(quán)對法治建設(shè)的消極
