【摘要】：將分散在多個(gè)部門的行政許可權(quán),集中整合歸并到一個(gè)部門行使,以此消解部門對行政審批改革的掣肘,打破以審批為基礎(chǔ)構(gòu)建的傳統(tǒng)管理體制。相對集中行政許可權(quán)由此成為行政審批改革中推出的又一重大改革舉措。但將行政許可權(quán)從法定部門的職權(quán)中分離出來交給其他部門行使,涉及法定許可機(jī)關(guān)的變更和法定職權(quán)的轉(zhuǎn)移,因而,這一改革在理論上還未形成共識,實(shí)踐中還面臨著強(qiáng)大阻力。相對集中行政許可權(quán)改革的必要性、合法性、合理性以及技術(shù)性需要理論上的充分論證以及實(shí)踐中的不斷探索。
[Abstract]:The administrative permission power scattered in many departments will be centralized and integrated into one department so as to remove the constraints of administrative examination and approval reform and break the traditional management system constructed on the basis of examination and approval. The relative centralization of administrative permission has thus become another major reform initiative in the reform of administrative examination and approval. However, the separation of the administrative licensing power from the functions and powers of the statutory departments to be exercised by other departments involves the alteration of the statutory licensing organs and the transfer of the statutory functions and powers. Therefore, this reform has not reached a consensus in theory. In practice, there is also a strong resistance. The necessity, legitimacy, rationality and technical needs of the reform of the relative centralized administrative licensing right are fully demonstrated theoretically and continuously explored in practice.
