公民舉報(bào)交通違法的法律問(wèn)題研究

【摘要】:隨著政府的行政管理從行政統(tǒng)治走向行政服務(wù),越來(lái)越多的公民參與到社會(huì)公共事務(wù)的管理當(dāng)中來(lái),公民參與逐漸延伸到全社會(huì)多個(gè)層面的管理機(jī)制之中。作為一項(xiàng)源遠(yuǎn)流長(zhǎng)的,給予了公民參與、維護(hù)社會(huì)秩序的渠道,公眾參與觸及到了幾乎每一個(gè)涉及公共利益的社會(huì)環(huán)節(jié),反腐、環(huán)保、食品安全等領(lǐng)域,并發(fā)揮著越來(lái)越重要的作用,公民舉報(bào)監(jiān)督機(jī)制就是公民參與的重要體現(xiàn)。而在交通違法行為的治理方面,盡管一些地方交管部門(mén)通過(guò)制定行政管理辦法、條例、開(kāi)通舉報(bào)渠道、建立激勵(lì)機(jī)制等手段,將公民參與引入到交通違法行為的治理工作中來(lái),并取得了一定的實(shí)踐經(jīng)驗(yàn),但仍然在立法和頂層制度設(shè)計(jì)上缺乏統(tǒng)一規(guī)劃和行政資源投入,公民參與到交通治理領(lǐng)域仍未形成共識(shí),其可操作性不夠完善,實(shí)踐效果不夠理想。我們認(rèn)為,通過(guò)頂層設(shè)計(jì)和制度建設(shè),能夠?qū)⒐衽e報(bào)監(jiān)督機(jī)制引入到交通違法行為的監(jiān)督和管理當(dāng)中來(lái),在一定程度上將成為交管部門(mén)在行政資源不足的情況下的輔助力量,更好地打擊交通違法行為,進(jìn)而遏制交通違法行為對(duì)公民合法權(quán)益的侵害,維護(hù)社會(huì)公共利益和秩序。本文擬從交通違法監(jiān)督和管理問(wèn)題的視角出發(fā),梳理公民監(jiān)督舉報(bào)機(jī)制的形成、演變,并分析在交通違法監(jiān)督領(lǐng)域,引入公民舉報(bào)監(jiān)督機(jī)制的可行性。提出有效公民監(jiān)督的要件,進(jìn)而提出加強(qiáng)與促進(jìn)公民舉報(bào)監(jiān)督機(jī)制在交通違法監(jiān)督領(lǐng)域的對(duì)策。
[Abstract]:With the change of government administration from administrative rule to administrative service, more and more citizens participate in the management of social public affairs, and citizen participation gradually extends to the multi-level management mechanism of the whole society. As a long-standing channel that has given citizens participation and maintained social order, public participation has touched almost every social link involving the public interest, anti-corruption, environmental protection, food safety, and so on. And playing a more and more important role, citizen reporting supervision mechanism is an important manifestation of citizen participation. With regard to the governance of traffic violations, although some local traffic control departments have introduced citizen participation into the management of traffic violations through the formulation of administrative measures, regulations, the opening of reporting channels, the establishment of incentive mechanisms, and so on. Some practical experience has been obtained, but there is still a lack of unified planning and administrative resource input in legislation and top-level system design, the citizen's participation in the field of traffic governance has not yet formed a consensus, its operability is not perfect enough, the practical effect is not ideal. We believe that through the top-level design and system construction, we can introduce citizen reporting and supervision mechanisms into the supervision and management of traffic violations, and to a certain extent will become the auxiliary force of traffic control departments in the case of insufficient administrative resources. Better crack down on traffic violations, and then curb the violation of citizens' legitimate rights and interests, and maintain public interests and order. From the angle of view of traffic illegal supervision and management, this paper analyzes the formation and evolution of citizen supervision and reporting mechanism, and analyzes the feasibility of introducing citizen reporting supervision mechanism in the field of traffic illegal supervision. This paper puts forward the elements of effective citizen supervision, and then puts forward the countermeasures to strengthen and promote the supervision mechanism of citizen reporting in the field of traffic illegal supervision.
