【摘要】：獨特的民俗習慣、宗教信仰、民居特色等因素使少數(shù)民族地區(qū)的集體經(jīng)營性建設(shè)用地流轉(zhuǎn)不能簡單套用"規(guī)劃管制+市場化"模式,而應(yīng)擴大少數(shù)民族集體在流轉(zhuǎn)領(lǐng)域的自治權(quán)。營利性使用的祭祀用地與公益用地可以流轉(zhuǎn)。應(yīng)尊重少數(shù)民族選擇流轉(zhuǎn)方式與定價的權(quán)利,流轉(zhuǎn)的增值收益應(yīng)盡量保留于少數(shù)民族集體內(nèi)部,尊重少數(shù)民族的收益分配習俗。
[Abstract]:The unique folklore custom, religious belief, folk house characteristic and other factors make the circulation of the collective management construction land in the minority area can not simply apply the mode of "planning control marketization". Instead, we should expand the autonomy of ethnic collectives in the field of circulation. The land for sacrifice and the land for public welfare used for profit can be transferred. The rights of minority nationalities to choose circulation mode and pricing should be respected, and the value added proceeds of circulation should be kept within the collective of minority nationalities as far as possible, and the customs of income distribution of minority nationalities should be respected.
