【摘要】：本文從結(jié)構(gòu)功能主義視角出發(fā),根據(jù)執(zhí)法機(jī)構(gòu)和基層執(zhí)法人員所處的結(jié)構(gòu)性位置,探討基層執(zhí)法中差序格局出現(xiàn)的內(nèi)涵、機(jī)理和發(fā)生機(jī)制。研究發(fā)現(xiàn),作為政府一部分,執(zhí)法工作卻由于處于政府工作的邊緣位置而不得不為了配合政府的中心工作而妥協(xié);因"治理體系碎片化",本應(yīng)多個(gè)部門聯(lián)合的執(zhí)法工作卻由于不同的部門利益導(dǎo)致部門博弈,反而極大限制了單個(gè)部門的公平執(zhí)法;而科層制結(jié)構(gòu)底端的基層執(zhí)法人員不僅要承受組織內(nèi)部自上而下的各種壓力,還要承受來自城市原子化社會(huì)結(jié)構(gòu)中的生活風(fēng)險(xiǎn),為此,基層執(zhí)法人員不得不利用信息傳遞結(jié)構(gòu)中的信息不對(duì)稱優(yōu)勢(shì)和公務(wù)員身體結(jié)構(gòu)的保護(hù),通過策略性變通使用法律法規(guī)來構(gòu)建出一個(gè)不平等的執(zhí)法差序格局。
[Abstract]:From the perspective of structural functionalism and according to the structural position of law enforcement agencies and law enforcement officers at the grass-roots level, this paper discusses the connotation, mechanism and occurrence mechanism of the pattern of disparity in law enforcement at the grass-roots level. Because of the fragmentation of the governance system, the law enforcement work which should be joined by many departments leads to the game of departments because of the different interests of departments, but greatly limits the fair law enforcement of individual departments; and the grass-roots law enforcement officers at the bottom of the bureaucracy not only bear the pressure from the top down within the organization, but also bear the pressure. For this reason, grassroots law enforcement officers have to take advantage of information asymmetry in the information transmission structure and the protection of civil servants'physical structure to construct an unequal pattern of law enforcement by using laws and regulations strategically.
