【摘要】：長期以來,我國的經(jīng)濟發(fā)展都是建立在巨大的資源消耗基礎(chǔ)之上,對于環(huán)境資源過分索取和破壞,嚴重威脅到了人民群眾的生活環(huán)境和經(jīng)濟的可持續(xù)發(fā)展,因此環(huán)境行政執(zhí)法日益受到政府的高度重視,成為各國環(huán)境管理的一項重要內(nèi)容。盤錦市遼河保護區(qū)作為一個正在發(fā)展中的地域,同樣存在包括水源污染、一般固體廢棄物污染防治、大氣污染以及資源過度開發(fā)等等的環(huán)境問題,解決這些問題,很大程度上還要依靠環(huán)境行政執(zhí)法。而環(huán)境執(zhí)法能力對于強化環(huán)境執(zhí)法、提高環(huán)境執(zhí)法的有效性、遏制環(huán)境污染和生態(tài)破壞,特別是對促進依法管理環(huán)境具有重要意義。因此,本文從提升環(huán)境執(zhí)法能力入手,以盤錦市公安局遼河保護區(qū)分局的執(zhí)法能力為研究對象,找尋執(zhí)法隊伍能力建設(shè)上的不足之處,為提升遼河保護區(qū)的執(zhí)法能力獻言獻策。第一部分簡要闡釋了文章的研究背景、研究對象和出發(fā)點,對于“環(huán)境執(zhí)法”和“環(huán)境執(zhí)法能力”的基本含義進行了概念厘定,最后在總結(jié)歸納了先前學(xué)者對于環(huán)境執(zhí)法能力的相關(guān)研究成果的基礎(chǔ)之上,確定了研究框架。第二部分以盤錦市公安局遼河保護區(qū)分局執(zhí)法現(xiàn)狀為研究對象,通過結(jié)構(gòu)性訪談獲得相關(guān)數(shù)據(jù),總結(jié)歸納了盤錦市公安局遼河保護區(qū)分局環(huán)境執(zhí)法能力的現(xiàn)狀,分析了其執(zhí)法能力的薄弱環(huán)節(jié),指出了遼河保護區(qū)分局存在著環(huán)境執(zhí)法隊伍人員偏少、政府干預(yù)環(huán)境執(zhí)法情況時有發(fā)生、環(huán)境執(zhí)法資金投入過少、環(huán)境執(zhí)法手段不靈活等種種問題,并以此為出發(fā)點,分析了造成這些不足的原因,主要包含環(huán)境執(zhí)法工作人員錄用機制缺失、政府與執(zhí)法部門地方保護主義嚴重、環(huán)保資金使用監(jiān)督機制匱乏、環(huán)境執(zhí)法隊伍執(zhí)法理念不強等。第三部分從造成遼河保護區(qū)執(zhí)法能力不足的諸多原因出發(fā),以相關(guān)理論為研究工具,借鑒了國內(nèi)外執(zhí)法能力建設(shè)的有益經(jīng)驗,提出了提升遼河保護區(qū)分局環(huán)境執(zhí)法能力的方案框架。最后從盤錦市遼河保護區(qū)的實際情況出發(fā),合理地論證了該方案框架的可行性,為后續(xù)政策建議的提出提供了框架支撐。第四部分主要針對盤錦市公安局遼河保護區(qū)分局提升環(huán)境執(zhí)法能力給出了具體建議,包括加強環(huán)境執(zhí)法隊伍建設(shè)、規(guī)范政府與環(huán)境執(zhí)法部門自身建設(shè)、完善遼河保護區(qū)分局環(huán)境執(zhí)法資金投入機制、豐富遼河保護區(qū)分局環(huán)境執(zhí)法手段等。第五部分是文章的結(jié)論部分。該部分重新對文章進行了歸納總結(jié),體現(xiàn)了對其他地區(qū)的普適性,指出了研究存在的不足之處,對于進一步研究進行了展望。
[Abstract]:For a long time, the economic development of our country has been based on the huge resource consumption, which has seriously threatened the people's living environment and the sustainable development of the economy. Therefore, environmental administrative law enforcement is paid more and more attention by the government and becomes an important part of environmental management. As a developing area, the Liaohe Reserve of Panjin City also has environmental problems, including water pollution, pollution prevention and control of general solid waste, air pollution and over-exploitation of resources, etc., to solve these problems. To a large extent, also rely on environmental administrative law enforcement. The ability of environmental law enforcement is of great significance to strengthen environmental law enforcement, to improve the effectiveness of environmental law enforcement, to curb environmental pollution and ecological damage, especially to promote the management of environment according to law. Therefore, this paper starts with the enhancement of environmental law enforcement ability, taking the law enforcement ability of Liaohe Reserve Bureau of Panjin Public Security Bureau as the research object, looking for the deficiency of the law enforcement team's ability construction, and offering suggestions for improving the law enforcement ability of the Liaohe protection area. The first part briefly explains the research background, research object and starting point of the article, and defines the basic meaning of "environmental law enforcement" and "environmental law enforcement capacity". Finally, on the basis of summarizing and summarizing the previous research results on environmental law enforcement capacity, the research framework is established. The second part of Panjin Public Security Bureau Liaohe protection area law enforcement status as the research object, through structural interviews to obtain relevant data, summed up Panjin Public Security Bureau Liaohe Protection area sub-bureau environmental law enforcement capacity status quo. This paper analyzes on the weak links of its law enforcement ability, points out that there are few personnel in the environmental law enforcement team in Liaohe Reserve Branch Bureau, the situation of government intervention in environmental law enforcement occurs from time to time, and the investment of environmental law enforcement funds is too small. Some problems, such as inflexibility of environmental law enforcement methods, and taking this as a starting point, are analyzed to analyze the causes of these deficiencies, including the lack of employment mechanism for environmental law enforcement personnel and the serious local protectionism between the government and law enforcement departments. The environmental protection fund use supervision mechanism is deficient, the environmental law enforcement troop law enforcement idea is not strong and so on. The third part of the Liaohe protection area from the causes of insufficient law enforcement capacity, with the relevant theory as a research tool, drawing on the useful experience of domestic and foreign law enforcement capacity building, The scheme framework of improving the environmental law enforcement capacity of Liaohe Reserve Bureau is put forward. Finally, from the actual situation of Liaohe Reserve in Panjin City, the feasibility of the scheme framework is proved reasonably, which provides the frame support for the following policy suggestions. The fourth part mainly gives the concrete suggestion for the Panjin Public Security Bureau Liaohe protected area Branch Bureau to enhance the environmental law enforcement ability, including strengthening the construction of the environmental law enforcement team, standardizing the government and the environmental law enforcement department's own construction. To improve the investment mechanism of environmental law enforcement in Liaohe protection area, enrich the environmental law enforcement means of Liaohe protection area. The fifth part is the conclusion of the article. In this part, the article is summarized and summarized again, which reflects the universality of other regions, points out the shortcomings of the research, and looks forward to further research.
