【摘要】：規(guī)范煙草專賣經(jīng)營(yíng)、零售許可行為,是加強(qiáng)法治煙草建設(shè)的題中之義。通過擷取實(shí)踐中普遍存在的非法轉(zhuǎn)讓許可證、規(guī)避法定渠道購進(jìn)煙草制品及經(jīng)營(yíng)企業(yè)法定代表人變更等案例,剖析煙草專賣許可行為在法律界定、執(zhí)法約束、法律銜接及后續(xù)監(jiān)管方面的原因,并進(jìn)一步發(fā)掘煙草專賣許可行為在實(shí)踐中存在的審批單向決定、監(jiān)管一條腿走路、固定經(jīng)營(yíng)場(chǎng)所要件單一及退機(jī)機(jī)制不完善等問題。根據(jù)問題提出對(duì)策,在執(zhí)法理念、立法規(guī)定、程序安排及全程監(jiān)管維度提出個(gè)人粗淺建議。
[Abstract]:Standardizing tobacco monopoly management and retail licensing is the key to strengthen the construction of tobacco under the rule of law. Through obtaining the cases of illegal transfer of license, circumventing the cases of purchasing tobacco products through legal channels and changing the legal representatives of enterprises, this paper analyzes the legal definition and law enforcement of tobacco monopoly licensing. The reasons of the legal convergence and subsequent supervision, and further explore the practice of tobacco monopoly licensing in the practice of one-way decisions, supervision of one leg walking, fixed business place requirements are single and the mechanism is not perfect and so on. According to the problems, the author puts forward some suggestions in the aspects of law enforcement, legislation, procedure and supervision.
