【摘要】：當(dāng)下的中國(guó)社會(huì)正在經(jīng)歷著從農(nóng)業(yè)社會(huì)向工業(yè)社會(huì)轉(zhuǎn)變、從傳統(tǒng)社會(huì)向現(xiàn)代社會(huì)轉(zhuǎn)變的深刻變遷與發(fā)展,社會(huì)經(jīng)濟(jì)結(jié)構(gòu)、文化形態(tài)、價(jià)值觀念等都在發(fā)生深刻變化,這是社會(huì)變遷進(jìn)步史中的關(guān)鍵質(zhì)變時(shí)期,如何應(yīng)對(duì)社會(huì)轉(zhuǎn)型期帶來(lái)的各種挑戰(zhàn)是我們當(dāng)下必須回應(yīng)的時(shí)代話題。在整個(gè)國(guó)家治理中,在建設(shè)法治國(guó)家的進(jìn)程中,警察執(zhí)法的適法性和公正性是重要的一環(huán),直接關(guān)系到實(shí)現(xiàn)公民權(quán)利和維護(hù)社會(huì)秩序。而建立在法治的基礎(chǔ)上的警務(wù)活動(dòng)則必然的要求對(duì)警務(wù)活動(dòng)和警察權(quán)建立起有效的監(jiān)督制度。為了應(yīng)對(duì)社會(huì)轉(zhuǎn)型期的復(fù)雜局面警察權(quán)需要匹配行政強(qiáng)制性,這使得對(duì)警務(wù)活動(dòng)和警察權(quán)行使的監(jiān)督的難度也越來(lái)越大。在社會(huì)轉(zhuǎn)型期如何防止警察權(quán)被濫用,促使公權(quán)力有效服務(wù)于社會(huì)公平正義,并確保社會(huì)穩(wěn)定和諧建設(shè),意義重大。本文聚焦警務(wù)監(jiān)督制度建設(shè),在如何強(qiáng)化公安機(jī)關(guān)執(zhí)法監(jiān)督和推進(jìn)公安督察規(guī)范化建設(shè)、在國(guó)家全面依法治國(guó)政策背景要求下,以如何實(shí)效的提高新時(shí)期警務(wù)監(jiān)督工作的效果為問(wèn)題意識(shí),結(jié)合警務(wù)監(jiān)督制度建設(shè)相關(guān)的理論,對(duì)學(xué)界關(guān)于監(jiān)督體制建設(shè)的研究情況作了概述,明確了研究思路。論文以問(wèn)題意識(shí)為導(dǎo)向,分析了我國(guó)警務(wù)監(jiān)督制度建設(shè)的歷史沿革與現(xiàn)狀,包括警務(wù)督察和公安系統(tǒng)外部司法監(jiān)督等主要內(nèi)容,并對(duì)當(dāng)前我國(guó)警務(wù)監(jiān)督制度實(shí)踐運(yùn)行中存在的問(wèn)題進(jìn)行了分析,對(duì)問(wèn)題背后的原因進(jìn)行了挖掘,在此基礎(chǔ)上對(duì)應(yīng)的提出了完善警務(wù)監(jiān)督制度建設(shè)的對(duì)策建議。全文共分為五個(gè)部分,第一部分引言從問(wèn)題的提出及意義、研究現(xiàn)狀、研究設(shè)計(jì)及創(chuàng)新之處等四個(gè)方面進(jìn)行,為后文的寫(xiě)作做基本的鋪墊和闡述;第二部門(mén)從基本概念內(nèi)涵等方面展開(kāi),為文章提供寫(xiě)作的理論基礎(chǔ);第三部門(mén)著重討論警務(wù)監(jiān)督制度的現(xiàn)狀,對(duì)其存在的主要問(wèn)題做詳細(xì)分析;第四部份則探討監(jiān)督在實(shí)踐中成效不顯的具體原因;第五部分指出完善警務(wù)監(jiān)督制度建設(shè)需要關(guān)注的方面,給出相關(guān)對(duì)策。
[Abstract]:The current Chinese society is undergoing profound changes from the agricultural society to the industrial society, from the traditional society to the modern society, and from the social economic structure, the cultural form, the values, etc. This is a critical period of qualitative change in the history of social change and progress. In the whole national governance and the process of building a country ruled by law, the proper law enforcement and fairness of the police law enforcement is an important link, which is directly related to the realization of civil rights and the maintenance of social order. On the other hand, the police activities based on the rule of law will inevitably require the establishment of an effective supervisory system for police activities and police power. In order to cope with the complex situation of the social transition, the police power needs to match the administrative compulsion, which makes it more and more difficult to supervise the police activities and the exercise of the police power. It is of great significance to prevent the abuse of police power, to promote the public power to serve social fairness and justice effectively, and to ensure the construction of social stability and harmony in the period of social transformation. This paper focuses on the construction of police supervision system, how to strengthen the supervision of law enforcement by public security organs and how to promote the standardization construction of public security inspectors, under the background of the national policy of governing the country according to law. Taking how to effectively improve the effect of police supervision work in the new period as a problem consciousness, combined with the relevant theories of police supervision system construction, this paper summarizes the research situation of academic circles on supervision system construction, and clarifies the research ideas. Guided by problem consciousness, the paper analyzes the history and present situation of the construction of police supervision system in China, including the main contents of police inspector and external judicial supervision of public security system, etc. This paper also analyzes the problems existing in the practice and operation of the police supervision system in our country, excavates the reasons behind the problems, and puts forward corresponding countermeasures and suggestions to perfect the police supervision system construction on this basis. The paper is divided into five parts. The first part of the introduction from the question and its significance, research status, research design and innovation of the four aspects, for the following writing to do the basic foreshadowing and elaboration; The second part from the basic concept connotation and other aspects to provide the theoretical basis for writing the third part focuses on the status quo of the police supervision system to make a detailed analysis of its main problems; The fourth part discusses the concrete reasons why supervision is not effective in practice, and the fifth part points out the aspects that need to be paid attention to perfect the police supervision system, and gives the relevant countermeasures.
