【摘要】：根據(jù)我國法律現(xiàn)狀,在公有制的大前提下,本文通過解構(gòu)何人以何種方式獲得宅基地使用權(quán)的論述結(jié)構(gòu),來達(dá)到充分論述宅基地使用權(quán)主體制度的目的。作為一個(gè)從解放以來就存在的,關(guān)乎于我國大部分人口具體權(quán)利的土地政策,直到現(xiàn)在的法律運(yùn)行中都有著難以解釋明白甚至模糊的地方,因此,本文希望通過分為以下四個(gè)部分來說明現(xiàn)行法律制度中的問題并提出解決方案。第一部分是宅基地使用權(quán)主體制度的基本理論。對(duì)宅基地使用權(quán)主體制度的相關(guān)概念進(jìn)行學(xué)術(shù)闡述,包括其由來發(fā)展和學(xué)術(shù)上的定義,希望能從現(xiàn)行法的角度來厘定什么是宅基地,從而確定宅基地主體的主要身份背景。第二部分是宅基地使用權(quán)主體制度的不足,即宅基地使用權(quán)主體的確定。在現(xiàn)實(shí)的法律運(yùn)行中,恰恰是因?yàn)檫@些不足,使得現(xiàn)有的大陸宅基地使用權(quán)主體制度在實(shí)際操作中存在著許多難以解決的問題,因此,我們更應(yīng)該從問題本身出發(fā),找出解決問題的方法。第三部分是宅基地使用權(quán)主體制度的完善。針對(duì)第二章提出的問題,參照我國的現(xiàn)行判例以及政府公開問答等有權(quán)解釋來解決現(xiàn)行法律運(yùn)行中沒有規(guī)定或者規(guī)定模糊等問題進(jìn)行完善。第四部分是宅基地使用權(quán)主體制度的延伸,即宅基地使用權(quán)的市場(chǎng)化展望。通過對(duì)現(xiàn)有的宅基地市場(chǎng)的觀察總結(jié)以及結(jié)合香港丁權(quán)土地使用權(quán)交易市場(chǎng)考察來討論宅基地市場(chǎng)化的可能性。
[Abstract]:According to the present legal situation of our country, under the premise of the public ownership, this article discusses the main body system of the homestead use right by deconstructing the structure of who obtains the right to use the homestead in what way, so as to achieve the purpose of fully discussing the subject system of the homestead use right. As a land policy that has existed since liberation and concerned the specific rights of the majority of the population of our country, until now, the law has been difficult to explain and even obscure, so, This article hopes to divide into the following four parts to explain the problems in the current legal system and to propose solutions. The first part is the basic theory of the subject system of homestead use right. This paper expounds the related concepts of the subject system of homestead use right, including its origin, development and academic definition, hoping to determine what is homestead from the angle of current law, and thus determine the main background of the subject of homestead. The second part is the deficiency of the subject system of homestead use right, that is, the determination of the subject of homestead use right. In the actual operation of the law, precisely because of these deficiencies, the existing mainstay land use right system in the actual operation of many difficult problems, therefore, we should start from the problem itself, Find a solution to the problem. The third part is the perfection of the subject system of homestead use right. In view of the problems raised in the second chapter, the author makes a perfect solution to the problems of no or vague provisions in the operation of the current law by referring to the current jurisprudence of our country and the right to explain the government's open question and answer. The fourth part is the extension of the subject system of homestead use right, that is, the market outlook of homestead use right. This paper discusses the possibility of homestead marketization by observing and summarizing the existing homestead market and combining with the investigation of the trading market of the right of land use in Hong Kong.
