【摘要】：社會政策作為關涉公民福祉的重要領域,與行政法學上給付行政具有很多共通之處。社會政策體現了國家與社會的勾連,其變動也為行政法學提出了新的研究課題。同時,在具體的社會政策執(zhí)行時,也需要行政法的保障。在日漸重視社會政策的中國當下,行政法學研究者也應沿著妥當的進路才能對這一問題進行深入探究。這要求行政法學引入需求視角,關注社會政策的執(zhí)行與法效果,進而考察社會政策中的多元法律關系與主體,并借助公私混合視角加以分析。
[Abstract]:Social policy, as an important field involving the well-being of citizens, has a lot in common with administrative law. Social policy embodies the connection between the state and the society, and its changes have also put forward new research topics for administrative law. At the same time, when the specific social policy is implemented, it also needs the guarantee of administrative law. In the present period of China's policy, the administrative law researchers should also follow the appropriate approach to explore this problem. This requires administrative law to introduce the demand perspective, pay attention to the implementation of social policy and the effect of law, and then examine the multiple legal relations and subjects in social policy, and analyze it with the help of a mixed public and private perspective.
