基于學(xué)生權(quán)利的高校受教育權(quán)糾紛處理機(jī)制研究

【摘要】:近年來高校學(xué)生因?qū)W校對(duì)其違紀(jì)違規(guī)處理過當(dāng)或者不能接受相應(yīng)的處分結(jié)果,將母校告上法庭的案件時(shí)有發(fā)生。學(xué)生認(rèn)為學(xué)校的處理結(jié)果嚴(yán)重的侵害到其基本權(quán)利受教育權(quán)或其他的民事權(quán)利。這種現(xiàn)象一方面被認(rèn)為是大學(xué)生的自我保護(hù)的法律意識(shí)不斷地提升的結(jié)果,另一方面也折射出高校在處理學(xué)生違反相關(guān)規(guī)定和保護(hù)學(xué)生的權(quán)利過程中存在著不合法規(guī)之處。在我國(guó)高校法律關(guān)系主體中,一方是以培養(yǎng)人才為核心目標(biāo)的高等院校,一方是以求學(xué)為目的的接受高等教育的學(xué)生,兩者本該是站在同一個(gè)利益場(chǎng)地,到底是什么讓兩者對(duì)簿于公堂。為了探索其中原因和解決其中的問題,首先對(duì)高校違紀(jì)違規(guī)處理與學(xué)生受教育權(quán)利法理分析,并結(jié)合高校受教育糾紛的案例及糾紛產(chǎn)生的原因進(jìn)行研究;同時(shí)對(duì)高校受教育處分糾紛類型與大學(xué)生法律救濟(jì)途徑進(jìn)行闡釋,進(jìn)一步的對(duì)高校受教育權(quán)糾紛處理機(jī)制建設(shè)針對(duì)性的提出意見。高校受教育權(quán)糾紛、學(xué)生權(quán)利等相關(guān)概念的學(xué)術(shù)含義進(jìn)行闡釋,探究高校受教育權(quán)被侵害產(chǎn)生糾紛的原因、類型、探索解決糾紛的各種途徑,為建設(shè)和諧校園,民主校園,和維護(hù)大學(xué)生群體的受教育權(quán)利,依法治校等建言獻(xiàn)策,努力探索學(xué)生權(quán)利維護(hù)和高校管理之間如何和諧發(fā)展,取得雙贏。隨著法治社會(huì)觀念的深入人心,高等教育法治教育的改革,依法治校、治教的思想的深入貫徹,當(dāng)學(xué)生的合法權(quán)利受到損害時(shí),學(xué)校或者教育行政部門的侵害其行為時(shí),作為教育管理相對(duì)人學(xué)生具有維護(hù)自己的合法權(quán)利的能力,并做出合法的訴求與救濟(jì)行為。同樣,高等院校為了高效率的管理本校應(yīng)建立自己的一套符合學(xué)校實(shí)際情況的管理秩序,擁有自主辦學(xué),依法治校的一定權(quán)利,在學(xué)生違反學(xué)校的規(guī)章制度,高校有按相關(guān)規(guī)定處分學(xué)生的權(quán)利,并充分體現(xiàn)程序的正當(dāng)性。
[Abstract]:In recent years, students in Colleges and universities have dealt with or cannot accept the results of disciplinary violations by the school. They have taken the alma mater's case to court. Students think that the results of the school's treatment are seriously infringed on their basic rights to be educated or other civil rights. This phenomenon is considered to be the self of college students on the one hand. The result of the continuous promotion of the legal consciousness of protection, on the other hand, also reflects that there are no laws and regulations in the process of dealing with students' violation of relevant regulations and protection of students' rights. In the subject of legal relations in Colleges and universities in our country, one party is a University with the core goal of cultivating talents, and the other is to accept it as the purpose. In order to explore the reasons and solve the problems, the students of higher education should be standing in the same interest field. In order to explore the reasons and solve the problems, first of all, this paper analyzes the legal analysis of the handling of violation of discipline and the right to education of the students in Colleges and universities, and studies the reasons of the disputes arising from the dispute of teaching and education in Colleges and universities. At the same time, it explains the types of dissension disputes in Colleges and universities and the way of legal relief for college students, and further puts forward some suggestions on the construction of the mechanism for the treatment of the right to education in Colleges and universities. The academic meaning of the concepts of the right to education and the rights of the students is explained, so as to explore the origin of the disputes arising from the infringement of the right to education in Colleges and universities. In order to build a harmonious campus, a democratic campus, and maintain the right to receive education for the college students and to run a school in accordance with the law, we will try to explore the harmonious development between the rights of students and the management of colleges and universities to achieve a win-win situation. When the legal rights of the students are damaged, when the students' legal rights are damaged, the schools or the educational administrative departments have infringed their behavior, they have the ability to maintain their legitimate rights and make legal appeals and relief actions. The school should establish its own set of management order in line with the actual situation of the school, have the right to run school independently, rule the school according to law, violate the rules and regulations of the school, dispose of the rights of the students according to the relevant regulations, and fully reflect the legitimacy of the procedure.
