【摘要】：國家和人民賦予了人民警察依法使用警械武器的基本權(quán)力,為人民警察依法履職提供了重要保障,這也是保護人民群眾和自身安全的基本需要。目前,我國處于矛盾和敏感問題多發(fā)期,警械武器的使用是新時期人民警察執(zhí)法不可或缺的一項基本技能。我國人民警察使用警械武器的法律體系較為完整,涵蓋了法律、行政法規(guī)、部門規(guī)章,即便如此,實戰(zhàn)中人民警察使用警械武器存在著態(tài)度消極、規(guī)范性差等特點。本文通過對公安機關(guān)人民警察使用警械武器的現(xiàn)有狀況進行闡述和分析,結(jié)合多年典型案例,揭示導(dǎo)致公安機關(guān)人民警察使用槍械問題的原因,進而從提高法律法規(guī)位階、完善槍械配備制度、建立與槍械使用配套的警情等級制度、完善監(jiān)督管理體系等方面提出合理性、可行性建議。
[Abstract]:The state and the people have given the people's police the basic power to use their weapons according to law, which provides an important guarantee for the people's police to carry out their duties according to law, which is also the basic need to protect the people's masses and their own safety. At present, China is in a period of frequent contradictions and sensitive problems, and the use of armed weapons is an indispensable basic skill of the people's police in the new period. The legal system of police weapon use in our country is relatively complete, including laws, administrative regulations, department rules and regulations. Even so, in actual combat, there are some characteristics such as negative attitude and poor standardization in the use of police armed weapons by people's police. Based on the exposition and analysis of the current situation of the people's police using armed weapons in public security organs, and combining with the typical cases for many years, this paper reveals the reasons leading to the problem of the people's police using firearms in the public security organs, and then raises the rank of laws and regulations. The rationality and feasibility suggestions are put forward in improving the system of firearm equipping, establishing the police situation grade system matching with the use of firearms, perfecting the supervision and management system and so on.
