【摘要】：區(qū)域合作協(xié)議是我國(guó)區(qū)域發(fā)展與治理實(shí)踐中出現(xiàn)的一種新的制度形式。對(duì)于區(qū)域合作協(xié)議的屬性和效力,盡管可以分別從"是行政契約還是行政合同"、"是硬法還是軟法"的理論框架中進(jìn)行分析,但是區(qū)域合作協(xié)議具有復(fù)雜性和特殊性,它難以被簡(jiǎn)單地視為一種行政契約或者具有軟法效力。將區(qū)域合作協(xié)議視為區(qū)域發(fā)展與治理實(shí)踐中一種獨(dú)立的規(guī)范形式,更為可取。鑒于區(qū)域合作協(xié)議包含政府合作與績(jī)效共享的理念,對(duì)傳統(tǒng)的政府治理模式而言是明顯的改變,因此我們可以期待區(qū)域合作協(xié)議成為一種新型的公法治理規(guī)范。
[Abstract]:Regional cooperation agreement is a new institutional form in the practice of regional development and governance in China. The properties and effectiveness of regional cooperation agreements can be analyzed from the theoretical framework of "the administrative contract or the administrative contract", "the hard law or the soft law", but the regional cooperation agreement has the complexity and particularity, It is difficult to be considered simply as an administrative contract or a soft law. It is preferable to regard the regional cooperation agreement as an independent normative form of regional development and governance practice. As the regional cooperation agreement contains the concept of government cooperation and performance sharing, it is a significant change to the traditional government governance model. We can expect the regional cooperation agreement to become a new norm of public law governance.
