【摘要】：經(jīng)濟(jì)新常態(tài)下,以提升供給質(zhì)量為主攻方向的供給側(cè)結(jié)構(gòu)性改革亟須通過配套立法完善法制保障。我國目前以管理型、限禁型為主的立法主要立足于對各領(lǐng)域社會關(guān)系的管控,在推進(jìn)供給質(zhì)量優(yōu)化升級方面作用有限。相對而言,促進(jìn)型立法在激發(fā)市場創(chuàng)新活力、發(fā)揮社會各方主體的質(zhì)量共治、提升供給質(zhì)量等方面具有明顯優(yōu)勢。在供給側(cè)結(jié)構(gòu)性改革的背景下,質(zhì)量促進(jìn)型立法應(yīng)當(dāng)定位于通過"指引"來驅(qū)動創(chuàng)新,發(fā)揮社會各方主體的共治作用,實(shí)現(xiàn)供給質(zhì)量提升對微觀產(chǎn)品服務(wù)質(zhì)量和宏觀經(jīng)濟(jì)增長質(zhì)量的"雙提高"效應(yīng);應(yīng)從指導(dǎo)性規(guī)范、鼓勵性規(guī)范等方面構(gòu)建規(guī)范的質(zhì)量促進(jìn)型立法;并綜合運(yùn)用個案推動、地方立法先行等立法策略推動質(zhì)量促進(jìn)型立法盡早出臺。
[Abstract]:Under the new normal state of economy, the supply-side structural reform, which aims at improving supply quality, needs to perfect the legal system through supporting legislation. At present, the legislation based on management and restriction is mainly based on the control of social relations in various fields, and plays a limited role in promoting the optimization and upgrading of supply quality. Comparatively speaking, promoting legislation has obvious advantages in stimulating the market innovation vigor, giving play to the quality co-management of all parties and improving the supply quality. In the context of supply-side structural reform, quality-promoting legislation should be positioned to drive innovation through "guidance" and give full play to the co-governing role of all parties in the society. To realize the "double improvement" effect of improving the supply quality on the microcosmic product service quality and the macroeconomic growth quality, we should construct the normative quality-promoting legislation from the aspects of guiding norms, encouraging norms and so on, and make comprehensive use of case studies. Local legislation and other legislative strategies to promote the quality of legislation as soon as possible.
