【摘要】：我國(guó)社會(huì)保障制度,從"效率優(yōu)先,兼顧公平"到"以人為本,統(tǒng)籌兼顧",歷經(jīng)了以勞動(dòng)保險(xiǎn)為主體的計(jì)劃經(jīng)濟(jì)時(shí)代的社會(huì)保障模式到以社會(huì)保險(xiǎn)為主體的市場(chǎng)經(jīng)濟(jì)時(shí)代的社會(huì)保障模式。在這期間,社會(huì)保險(xiǎn)立法也從法制化程度較低、內(nèi)容不夠完善等,發(fā)展為具有高位階的統(tǒng)一立法,統(tǒng)一了我國(guó)社會(huì)保險(xiǎn)制度。當(dāng)前是我國(guó)著力建設(shè)服務(wù)型政府時(shí)期,社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)作為全國(guó)參保的單位和個(gè)人進(jìn)行社會(huì)保險(xiǎn)公共服務(wù)提供的組織,其是否遵循社會(huì)保險(xiǎn)規(guī)章制度的規(guī)定和政策的要求、是否合理有效進(jìn)行社會(huì)保險(xiǎn)基金的管理等,直接影響我國(guó)服務(wù)型政府的建設(shè)。然而,時(shí)至今日《社會(huì)保險(xiǎn)法》對(duì)于社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)的性質(zhì)定位、功能等仍沒(méi)有明確規(guī)定,導(dǎo)致社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)工作在實(shí)踐中出現(xiàn)各地社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)具體功能履行不明、社會(huì)保險(xiǎn)基金征繳與管理混亂等問(wèn)題。因此,本文認(rèn)為有必要從立法的高度對(duì)社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)功能進(jìn)行重新建構(gòu)。通過(guò)立法對(duì)社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)功能重新建構(gòu),以立法明確經(jīng)辦機(jī)構(gòu)的法律性質(zhì)和功能,能夠更好地明晰其應(yīng)當(dāng)承擔(dān)的具體職責(zé)。在此基礎(chǔ)上,積極放開(kāi)對(duì)于經(jīng)辦機(jī)構(gòu)所負(fù)責(zé)的社會(huì)管理方面以及公共服務(wù)方面所應(yīng)當(dāng)具有的權(quán)限和享有的權(quán)利;同時(shí)明確經(jīng)辦機(jī)構(gòu)的法律責(zé)任,在經(jīng)辦機(jī)構(gòu)違反法律法規(guī)規(guī)定或者不履行法定義務(wù)時(shí),以法律手段追究其責(zé)任。相信經(jīng)過(guò)這樣的重新構(gòu)建,社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)的能力能夠穩(wěn)固提升,從而為大眾提供更加優(yōu)質(zhì)的經(jīng)辦管理服務(wù)。因此本文以法學(xué)角度從以下幾個(gè)方面行文:第一章為"社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)功能實(shí)地調(diào)研之分析",主要對(duì)調(diào)研地社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)的功能以及功能履行中的困難進(jìn)行介紹,由此引出研究社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)功能立法的必要性;第二章為"《社會(huì)保險(xiǎn)法》對(duì)社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)功能的規(guī)定和不足",主要介紹《社會(huì)保險(xiǎn)法》中對(duì)社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)功能的規(guī)定及存在的不足;第三章為"德國(guó)、美國(guó)、智利社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)功能之立法評(píng)析",主要對(duì)德國(guó)、美國(guó)、智利關(guān)于社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)功能和法律定位作一介紹;第四章"完善社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)功能之立法建議",從立法上明確我國(guó)社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)的功能。
[Abstract]:China's social security system, from "efficiency first, taking into account fairness" to "people-oriented," After taking labor insurance as the main body, the social security model in the planned economy era and the social security model in the market economy era with the social insurance as the main body has gone through. During this period, the legislation of social insurance has also developed from a low degree of legalization and imperfect content to a unified legislation with a high rank, thus unifying the social insurance system of our country. The current period of our country's efforts to build a service-oriented government, social insurance agencies as units and individuals participating in the national social insurance public service provision organizations, whether they comply with the social insurance regulations and policy requirements, Whether it is reasonable and effective to manage the social insurance fund directly affects the construction of the service-oriented government in our country. However, up to now, the Social Insurance Law has not clearly defined the nature and functions of social insurance agencies. In practice, some problems such as unclear functions of social insurance agencies, confusion in collection and management of social insurance funds and so on have occurred in the work of social insurance agencies. Therefore, it is necessary to reconstruct the functions of social insurance agencies from the perspective of legislation. In order to make clear the legal nature and function of the social insurance agency by legislation, it is possible to better clarify the specific responsibilities it should undertake in order to re-construct the function of the social insurance agency by legislation, and to clarify the legal nature and function of the agency through legislation. On this basis, we should actively liberalize the areas of social management and public services that are responsible for the agencies, and clarify the legal responsibilities of the agencies. If the agency violates laws and regulations or fails to fulfill its legal obligations, it shall be held liable by legal means. I believe that through this restructuring, the capacity of social insurance agencies can be steadily enhanced, thus providing better quality management services for the public. The first chapter is an analysis of the functions of social insurance agencies in the field of investigation. It mainly introduces the functions of social insurance agencies and the difficulties in their performance. Therefore, it is necessary to study the function legislation of social insurance agencies. The second chapter is "the social insurance law" to the social insurance agency organization function stipulation and the insufficiency, mainly introduces the "social insurance law" to the social insurance agency organization function stipulation and the existence insufficiency, the third chapter is "Germany, the United States," An Analysis of the legislation on the functions of Social Insurance agencies in Chile, which mainly introduces the functions and legal orientation of social insurance agencies in Germany, the United States and Chile; Chapter four, "legislation suggestion on perfecting the function of social insurance agency", clarifies the function of social insurance agency in our country.
