【摘要】：隨著中國社會經(jīng)濟的不斷發(fā)展,隨著反腐風暴的不斷深入,建立健全官員財產(chǎn)申報法律制度的呼聲日益強烈。世界上很多國家都建立了官員財產(chǎn)申報制度,國外的官員財產(chǎn)申報法律的內(nèi)容設(shè)置一般分為申報主體、申報內(nèi)容、申報時間、管理機構(gòu)和法律責任幾個部分。通過對每個申報法要素進行總結(jié),并對比我國頒布的《關(guān)于領(lǐng)導(dǎo)干部報告?zhèn)�人有關(guān)事項的規(guī)定》和實施現(xiàn)狀,找出我國官員財產(chǎn)申報法律制度立法的阻礙因素并進行分析。在我國,財產(chǎn)申報制度分為中央和地方(新疆阿勒泰、湖南瀏陽、浙江慈溪)兩個層面,雖然這些試點都為申報法律制度的實施積累了一些有益經(jīng)驗,但對在全國推廣官員財產(chǎn)申報法律制度的幫助有限。最后,通過綜合國內(nèi)外的法律和經(jīng)驗,對我國官員財產(chǎn)申報法律制度的構(gòu)建提出幾點建議：明確申報制度的法律地位,完善申報制度內(nèi)容和相應(yīng)的法律責任等。
[Abstract]:With the development of China's social economy and the deepening of anti-corruption storm, the voice of establishing and perfecting the legal system of official property declaration has become increasingly strong. Many countries in the world have established the official property declaration system. The contents of the law of official property declaration abroad are generally divided into declaration subject, declaration content, declaration time, management organization and legal responsibility. By summing up the elements of each declaration law and comparing the provisions on reporting personal matters by leading cadres issued by our country and the present situation of implementation, the author finds out the obstructing factors of the legislation of the legal system of official property declaration in China and makes an analysis. In China, the property declaration system is divided into two levels: central and local (Xinjiang Altay, Hunan Liuyang, Zhejiang Cixi). Although these pilot projects have accumulated some useful experience for the implementation of the declaration legal system, However, it is of limited help to popularize the legal system of official property declaration throughout the country. Finally, by synthesizing the domestic and foreign laws and experiences, this paper puts forward some suggestions on the construction of the legal system for the declaration of official property in our country: clarifying the legal status of the declaration system, perfecting the content of the declaration system and the corresponding legal responsibility, etc.
