論行政協(xié)議中行政相對人的權利救濟

【摘要】:行政協(xié)議作為一種幫助政府管理國家的手段在現(xiàn)代被廣泛的運用。與傳統(tǒng)的民事協(xié)議相比,其出現(xiàn)的時間以及發(fā)展的過程都短于或者滯后于社會發(fā)展的需要。隨著我國政府法治化的發(fā)展,行政理念也發(fā)生了很大的變化。政府職能開始從管理型政府到服務型政府的轉(zhuǎn)變,隨之而來的是大量行政協(xié)議的出現(xiàn)。然而行政協(xié)議雖然早已廣泛的實踐,但是由于其本身性質(zhì)的特殊性,關于行政協(xié)議的理論和立法仍然爭議不斷,至今未達到統(tǒng)一的認識。行政協(xié)議是現(xiàn)代行政管理中重要的組成方式,同時它也是政府行政管理權和協(xié)議關系的結合。作為一種新型的管理手段,它更好的體現(xiàn)了現(xiàn)代行政民主的思想,合作、包容以及非強制的特性,從產(chǎn)生以來在世界范圍內(nèi)就獲得了極大的發(fā)展和應用。一方面,它的出現(xiàn)打破了對于合同僅屬于私法領域的單純認識,另一方面,它也體現(xiàn)了現(xiàn)代私法領域與公法領域之間相互滲透、相互融合的發(fā)展趨勢。行政協(xié)議中行政主體享有許多實體上的權利,其存在是為了實現(xiàn)一定的行政管理的目的,達到維護社會公共利益的要求。只有行政協(xié)議當事人一方的行政主體所享有的,具有一定的強制性并優(yōu)先于合同相對人的權力,又可稱為行政優(yōu)益權、行政優(yōu)先權。行政優(yōu)益性使的行政相對方處于不對等的地位,這種弱者地位使得其權益很容易受到侵害,現(xiàn)行的《行政訴訟法》中加入了對政府處罰的制度并且對行政相對人的合法權益采取事前保護措施,盡可能避免會對當事人造成的損害,使對行政相對人的保護提高到一個新的水平。但是在實踐中行政相對人的權利仍然會受到行政主體的侵害,因此事后的救濟制度仍然必不可少。文章通過對三個典型行政協(xié)議案例的分析,提出實踐中我國對于行政協(xié)議相對人權利保護存在的問題。然后針對這些問題,提出完善的解決方法。在文中第三部分提倡確立懲罰性賠償制度以及賦予相對人程序?qū)箼鄟磉_到保護相對人利益、權利互相制約的目的。最后在文章的尾段,我通過對比調(diào)解制度與現(xiàn)行行政糾紛的解決途徑,認為調(diào)解制度的引入更有助于問題的解決和當事人權益的保護。
[Abstract]:Administrative agreement is widely used in modern times as a means to help the government manage the country. Compared with the traditional civil agreement, its emergence time and development process are shorter than or lag behind the needs of social development. With the development of our government's rule of law, the concept of administration has also changed a lot. The function of government began to change from management government to service government, followed by the emergence of a large number of administrative agreements. However, although the administrative agreement has long been widely practiced, due to its own particularity, the theory and legislation of administrative agreement are still controversial, so far it has not reached a unified understanding. Administrative agreement is an important form of modern administration, and it is also the combination of administrative power and agreement. As a new management means, it better reflects the modern administrative democracy thought, cooperation, tolerance and non-mandatory characteristics, since its emergence in the world has been a great development and application. On the one hand, it breaks the simple understanding that the contract belongs to the field of private law, on the other hand, it also reflects the trend of mutual penetration and integration between the field of modern private law and the field of public law. In the administrative agreement, the administrative subject enjoys many substantive rights, and its existence is to achieve the purpose of certain administration and to meet the requirements of safeguarding the social and public interests. Only the administrative subject of a party to an administrative agreement has a certain degree of compulsion and takes precedence over the power of the counterpart of the contract, which can also be called the administrative superior interest right and administrative priority. The administrative advantage makes the relative party of administration in an unequal position, which makes its rights and interests vulnerable to infringement. The current Administrative Litigation Law adds a system of punishment to the government and takes prior measures to protect the legitimate rights and interests of the administrative counterpart, so as to avoid, as far as possible, the harm that will be caused to the parties. So that the protection of the administrative counterpart to a new level. However, in practice, the rights of administrative counterpart will still be infringed by the administrative subject, so the relief system after the event is still necessary. Based on the analysis of three typical cases of administrative agreement, this paper puts forward the problems in the protection of the rights of the counterpart of administrative agreement in our country in practice. Then, in view of these problems, put forward the perfect solution. In the third part, the author advocates the establishment of punitive damages system and the right of countervailing procedure to protect the interests of the counterpart and restrict the rights of each other. Finally, at the end of the article, by comparing the mediation system with the existing administrative dispute settlement, I think that the introduction of mediation system is more conducive to the solution of problems and the protection of the rights and interests of the parties.
