食品安全政府信息公開制度研究

【摘要】:俗話說“民以食為天,,食以安為先”,食品有疑則民生不安。食品安全信息公開是保障食品安全供給的重要手段,食品安全信息公開不僅是《食品安全法》、《政府信息公開條例》的規(guī)定,也是保障公眾知情權(quán)、生命健康權(quán)的必然要求。因此,對其進(jìn)行深入的研究具有重要的現(xiàn)實意義。 本論文以食品安全法治的實踐需要為出發(fā)點,緊緊圍繞《食品安全法》、《政府信息公開條例》以及新公布的《食品安全法(修訂草案送審稿)》的相關(guān)規(guī)定,將研究焦點對準(zhǔn)食品安全信息公開制度的實施現(xiàn)狀上。針對現(xiàn)行制度在實踐中存在的不足和問題,在借鑒國外先進(jìn)制度經(jīng)驗的基礎(chǔ)上,提出相關(guān)問題的解決之道,以尋求法律規(guī)定與實踐實施之間的和諧。本文共由五個部分組成,具體內(nèi)容如下: 第一章是緒論部分,主要針對目前我國食品安全領(lǐng)域的亂象提出研究食品安全信息公開制度的必要性、研究現(xiàn)狀以及本文所采用研究方法等。 第二章是有關(guān)食品安全信息公開制度的概述,先界定了本文所研究的食品、食品安全的相關(guān)概念,進(jìn)而分析食品安全信息的屬性以及食品安全信息公開制度的理論基礎(chǔ)等問題。 第三章主要介紹了我國食品安全信息公開制度的立法現(xiàn)狀,考察我國食品安全信息公開的制度運作情況,最后指出我國食品安全信息公開目前存在的制度缺陷及不足。 第四章主要介紹了美國、德國等國相關(guān)的制度經(jīng)驗,主要從食品安全信息公開的主體、公開程序、權(quán)利救濟(jì)等角度進(jìn)行分析,并考察了相關(guān)制度在實踐中的運作情況。 最后一章是針對現(xiàn)階段我國食品安全信息公開的問題現(xiàn)狀,充分吸收美國、德國等發(fā)達(dá)國家相關(guān)制度的經(jīng)驗,提出完善我國食品安全信息公開制度的意見和建議。
[Abstract]:As the saying goes, "people take food as the day, food for peace", food doubt is people's livelihood anxiety. The disclosure of food safety information is an important means to ensure the supply of food safety. The disclosure of food safety information is not only the stipulation of the Food Safety Law and the regulations on the publicity of Government Information, but also the inevitable requirement of protecting the public's right to know and the right to life and health. Therefore, it is of great practical significance to study it in depth. Based on the practice of food safety and the rule of law, this paper focuses on the relevant provisions of the Food Safety Law, the regulations on the publicity of Government Information and the newly published Food Safety Law (revised draft to be submitted for review). Focus on the implementation of food safety information disclosure system. In view of the shortcomings and problems existing in the practice of the current system, on the basis of drawing lessons from the experience of foreign advanced systems, the author puts forward the solutions to the related problems in order to seek the harmony between the legal provisions and the practical implementation. This paper is composed of five parts. The main contents are as follows: the first chapter is the introduction part, which puts forward the necessity of studying the food safety information disclosure system in view of the disorder in the field of food safety in our country. The present situation of the research and the research methods adopted in this paper. The second chapter is an overview of the open system of food safety information. Firstly, it defines the related concepts of food and food safety, and then analyzes the attributes of food safety information and the theoretical basis of food safety information disclosure system. The third chapter mainly introduces the legislation status of the food safety information disclosure system in China, inspects the system operation of the food safety information disclosure system in China, and finally points out the defects and deficiencies of the food safety information disclosure system in our country at present. The fourth chapter mainly introduces the relevant system experience of the United States, Germany and other countries, mainly from the food safety information disclosure of the main body, public procedures, rights relief and other aspects of the analysis, and inspected the operation of the relevant system in practice. In the last chapter, according to the current situation of food safety information disclosure in China, the author fully absorbs the experience of relevant systems in developed countries such as the United States and Germany, and puts forward some suggestions and suggestions on how to perfect the food safety information disclosure system in China.
