【摘要】：記者要進(jìn)行新聞報道,最重要的也是第一位的事情是要進(jìn)行采訪。只有進(jìn)行有效采訪,才能更好地進(jìn)行報道。采訪不真實(shí)客觀,注定報道的新聞也是沒有意義的。記者采訪時可以采取的手段包括顯性采訪和隱性采訪。隱性采訪出現(xiàn)后的100多年來,在提供新聞事實(shí)、探索新聞?wù)嫦�、發(fā)揮輿論監(jiān)督方面發(fā)揮了重要作用。但是,記者在進(jìn)行隱性采訪時要對被訪者隱瞞真實(shí)身份和目的,本質(zhì)上是一種欺騙行為,在社會上引發(fā)巨大爭議。在英國、美國等國家,隱性采訪出現(xiàn)的時間比較早,隱性采訪20世紀(jì)90年代在我國迎來大發(fā)展,隨后隱性采訪在新聞報道中應(yīng)用的次數(shù)增多,呈現(xiàn)出一種更加興盛甚至可以說泛濫的態(tài)勢,其引發(fā)的糾紛也隨之增多,而現(xiàn)在我國的隱性采訪仍然處于無法可依的狀態(tài)。越來越多的學(xué)者主張運(yùn)用法律的手段對于隱性采訪進(jìn)行規(guī)制。因此,本文將對隱性采訪進(jìn)行分析,希望對隱性采訪進(jìn)行法律規(guī)制提出一些建議。文章的前言主要介紹本文的寫作背景與意義、文獻(xiàn)綜述以及研究方法。第一部分是隱性采訪的概述,主要介紹隱性采訪的定義及其基本特征以及國內(nèi)外發(fā)展現(xiàn)狀。第二部分是隱性采訪存在的原因及出現(xiàn)的問題。首先,從四個方面論述隱性采訪存在的原因,一方面,隱性采訪是媒體行使采訪權(quán)以及監(jiān)督權(quán)的體現(xiàn),另一方面,隱性采訪也能夠滿足受眾的知情權(quán);接著論述記者在運(yùn)用隱性采訪中存在的問題,包括兩方面內(nèi)容:一是侵權(quán)問題,侵犯如名譽(yù)權(quán)、隱私權(quán)、肖像權(quán)等,二是記者在隱性采訪中的違法行為,如記者參與到違法犯罪活動中、采用誘導(dǎo)式方式獲取新聞、使用非法工具。第三部分為法律規(guī)制,為了避免隱性采訪損害道德、平衡公共利益與個人利益以及彌補(bǔ)行業(yè)自律不足的需要,應(yīng)該對隱性采訪進(jìn)行法律規(guī)制。接下來從三個方面論述隱性采訪的原則;再接著論述我國現(xiàn)行法律規(guī)制的不足;最后,提出完善法律規(guī)制的建議,主要是從以下幾個方面:規(guī)定隱性采訪適用的條件和程序,明確隱性采訪的"度",分析隱性采訪侵權(quán)的責(zé)任承擔(dān)方式,分析隱性采訪中獲得的證據(jù)的效力。
[Abstract]:The reporter wants to carry on the news report, the most important and the first thing is to carry on the interview. Only by conducting an effective interview can the report be carried out better. The interview is not true and objective, and the news that is destined to be reported is meaningless. The means that the reporter can take when interview include explicit interview and recessive interview. Since the emergence of recessive interview, it has played an important role in providing news facts, exploring news truth and giving play to supervision by public opinion. However, it is essentially a deceptive act for reporters to conceal their true identity and purpose from the interviewees when conducting recessive interviews, which leads to great controversy in society. In Britain, the United States and other countries, recessive interviews appeared earlier. Recessive interviews developed greatly in China in the 1990s, and the number of applications of recessive interviews in news reports subsequently increased. Showing a more prosperous or even flooding situation, its disputes are also increasing, but now our country's recessive interview is still in a state that can not be relied on. More and more scholars advocate the use of legal means to regulate hidden interviews. Therefore, this article will analyze the recessive interview, hoping to make some suggestions on the legal regulation of the recessive interview. The preface of this paper mainly introduces the writing background and significance, literature review and research methods. The first part is an overview of recessive interview, mainly introduces the definition of recessive interview and its basic characteristics as well as the development situation at home and abroad. The second part is the hidden interview reasons and problems. First of all, from four aspects to discuss the reasons for the existence of hidden interviews, on the one hand, the hidden interview is the media exercise of the right to interview and the right to supervision, on the other hand, the hidden interview can also meet the audience's right to know; Then it discusses the problems existing in the use of recessive interviews by reporters, including two aspects: first, infringement, such as reputation, privacy, portrait rights, etc.; second, the illegal behavior of reporters in recessive interviews. If journalists participate in illegal and criminal activities, use inductive way to obtain news, use illegal tools. The third part is the legal regulation, in order to avoid the hidden interview damage morality, balance the public interest with the personal interest and make up the need of the industry self-discipline insufficiency, should carry on the legal regulation to the recessive interview. Then discusses the principle of recessive interview from three aspects; then discusses the deficiency of the current legal regulation in our country; finally, puts forward the suggestion to perfect the legal regulation, mainly from the following several aspects: prescribes the condition and the procedure of the application of the implicit interview, This paper clarifies the "degree" of recessive interview, analyzes the way to assume responsibility for the tort of recessive interview, and analyzes the effectiveness of the evidence obtained in recessive interview.
