【摘要】:建筑物區(qū)分所有權(quán)是隨著經(jīng)濟快速發(fā)展,建筑形式多樣化和施工技術(shù)不斷完善而產(chǎn)生的一種特殊的不動產(chǎn)所有權(quán)的形態(tài)。住宅小區(qū)或者建筑物的共有部分是建筑物區(qū)分所有權(quán)的核心重要問題。而在現(xiàn)實生活中,隨著我國社會發(fā)展,人口增多,城市聚居密度增大,因共有權(quán)問題引發(fā)的糾紛越來越多,而隨著土地價值的快速增長,對于住宅小區(qū)樓基外土地權(quán)屬的糾紛也逐漸成為建筑物區(qū)分所有權(quán)領(lǐng)域的焦點!蛾P(guān)于審理建筑物區(qū)分所有權(quán)糾紛案件具體應(yīng)用法律若干問題的解釋》的出臺對于我國區(qū)分所有權(quán)制度具有重要意義。在此基礎(chǔ)上,本文從界定建筑物區(qū)分所有權(quán)、專有權(quán)、共有權(quán)的概念和法律性質(zhì)入手,厘清共有權(quán)客體和內(nèi)容同時,立足于我國實際,進一步分析實踐中產(chǎn)生的具體問題,以期對現(xiàn)實生活中相關(guān)問題的解決有所幫助。 本文共分為三章。第一章為建筑物區(qū)分所有權(quán)基本理論的分析。首先,本文從一件生活中發(fā)生的共有部分糾紛案例出發(fā),引出研究建筑物區(qū)分所有權(quán)之共有權(quán)的重要意義。隨后,文章對建筑物區(qū)分所有權(quán)的形成和發(fā)展做了概述,厘清了建筑物區(qū)分所有權(quán)的歷史沿革。接下來,文章通過比較國內(nèi)外有關(guān)建筑物區(qū)分所有權(quán)的各種理論學(xué)說,系統(tǒng)論述了建筑物區(qū)分所有權(quán)的概念、法律性質(zhì)和客體的范圍和權(quán)利的內(nèi)容等基本問題。第二章重點探討住宅小區(qū)樓基外部分的權(quán)利歸屬問題。針對共有權(quán)的特殊客體,爭議頗多的為小區(qū)停車車位、車庫和小區(qū)綠地等的權(quán)利性質(zhì)及權(quán)利歸屬問題。比如開發(fā)商是否能取得小區(qū)綠地的專有使用權(quán),開發(fā)商對小區(qū)車位、車庫是否能只賣不租。本文結(jié)合國外立法經(jīng)驗進行深入分析。這些問題表明,我國迫切需要完善相關(guān)立法,特別是有必要制定一部全面調(diào)整區(qū)分所有權(quán)關(guān)系的法律。第三章討論了業(yè)主對樓基外部分的權(quán)利保護和救濟問題。文章分析了侵害共有權(quán)的相關(guān)理論和我國立法的相關(guān)規(guī)定,并對對如何避免侵權(quán)的產(chǎn)生以及侵權(quán)產(chǎn)生后如何進行侵權(quán)損害賠償提出一些法律建議。
[Abstract]:With the rapid development of economy, the diversification of building forms and the continuous improvement of construction technology, building ownership is a special form of real estate ownership. The residential district or the common part of the building is the core of building ownership. In real life, with the social development of our country, the population increases, the density of urban settlements increases, the disputes caused by the issue of co-ownership become more and more, and with the rapid growth of the value of land, The dispute of land ownership outside the base of residential district has gradually become the focal point in the field of building condominium ownership. China's differentiated ownership system is of great significance. On this basis, this paper begins with the definition of the concept and legal nature of building ownership, exclusive rights and co-ownership, clarifies the object and content of co-ownership, and at the same time, based on the reality of our country, further analyzes the specific problems arising in practice. With a view to real life in the solution of related problems to help. This paper is divided into three chapters. The first chapter is the analysis of the basic theory of building ownership. First of all, this paper starts from a case of common disputes in life, and leads to the significance of studying the co-ownership of building ownership. Then, the paper summarizes the formation and development of building ownership, and clarifies the history of building ownership. Then, by comparing various theories about building ownership at home and abroad, this paper systematically discusses the concept, legal nature, scope of object and content of right of building division ownership. The second chapter focuses on the ownership of the right outside the building. In view of the special object of co-ownership, there are many disputes about the property and ownership of the rights of parking spaces, garages and green spaces in residential areas. For example, developers can obtain the exclusive use of green space, developers of residential parking spaces, garages can only sell not to rent. This article combines the foreign legislative experience to carry on the thorough analysis. These problems indicate that our country urgently needs to perfect the relevant legislation, especially it is necessary to make a comprehensive adjustment of the law of differentiated ownership relationship. The third chapter discusses the owner's right protection and relief to the outside part of the building. This paper analyzes the relevant theories of infringement of common rights and the relevant provisions of our legislation, and puts forward some legal suggestions on how to avoid the occurrence of infringement and how to carry out tort compensation after infringement.
