道路交通事故認定法律問題研究

【摘要】:隨著我國經(jīng)濟社會的高速發(fā)展,人員和物資的流動空前頻繁,全社會的汽車保有量和駕駛?cè)藬?shù)量快速增長,而道路通車?yán)锍痰脑鲩L速度卻相對緩慢,道路交安全設(shè)施的建設(shè)也相對滯后,造成人、車、路、環(huán)境之間的矛盾凸顯,由此引發(fā)的道路交通事故數(shù)量也急劇增長。道路交通事故的發(fā)生嚴(yán)重地威脅著人們的生命財產(chǎn)安全,據(jù)不完全統(tǒng)計,近年來我國平均每年發(fā)生道路交通事故15萬余起,造成人員受傷15萬余人,造成人員死亡7萬余人,造成財產(chǎn)損失近10億元人民幣。道路交通事故發(fā)生后,每一個當(dāng)事人及其家屬無不希望能得到公正的處理,能得到合理的事故損害賠償。公安機關(guān)交通管理部門是處理道路交通事故的法定主體。在道路交通事故處理工作中,道路交通事故認定是最重要的環(huán)節(jié)。道路交通事故認定是一項法律性和專業(yè)性很強的工作,是公安機關(guān)交通管理部門對交通事故的基本事實、產(chǎn)生原因和當(dāng)事人的行為過錯及應(yīng)承擔(dān)的事故責(zé)任等作出的具體分析和認定!兜缆方煌ò踩ā芳捌渑涮追ㄒ(guī)規(guī)定,公安機關(guān)交通管理部門應(yīng)當(dāng)根據(jù)道路交通事故當(dāng)事人的違法行為對發(fā)生交通事故所起的作用以及該行為的過錯嚴(yán)重程度,確定道路交通事故當(dāng)事人的責(zé)任。由此可知,公安機關(guān)交通管理部門認定道路交通事故,一要依法確認道路交通事故中各方當(dāng)事人應(yīng)履行的法定義務(wù)以及何方當(dāng)事人應(yīng)當(dāng)優(yōu)先履行法定義務(wù),二要查找各方當(dāng)事人實施的引發(fā)道路交通事故的違法行為并確認該行為在道路交通事故中的作用大小,最后劃分各方當(dāng)事應(yīng)承擔(dān)的道路交通事故責(zé)任。道路交通事故認定實際上是公安交通管理部門對道路交通事故的成因分析,是對造成道路交通事故原因的確認。公安機關(guān)交通管理部門制作的道路交通事故認定書是當(dāng)事人是否承擔(dān)民事責(zé)任、行政責(zé)任、刑事責(zé)任的法律依據(jù)。我們要避免將公安交通管理部門的道路交通事故認定,簡單等同于當(dāng)事人民事責(zé)任的確定,應(yīng)將這一認定作為劃分當(dāng)事人事故責(zé)任的重要證據(jù)材料。在道路交通事故處理工作實踐中,由于未厘清道路交通事故基本概念、未區(qū)分道路交通事故責(zé)任與民事?lián)p害賠償責(zé)任等原因造成交通事故認定困難。道路交通事故認定是一項既有法治思維又有實戰(zhàn)技能的工作,法律性嚴(yán)、權(quán)威性強、專業(yè)性高、群眾性廣,面對新形勢新情況新問題,我們要用法治思維、法治方式去統(tǒng)領(lǐng)這項工作,要用學(xué)習(xí)提高的態(tài)度、務(wù)實有效的辦法去開展這項工作。本文中,筆者進一步強調(diào)了研究道路交通事故認定的現(xiàn)實意義,從道路交通事故的基本概念、基本理論入手,以實證分析法為基礎(chǔ),對現(xiàn)行法律制度框架下道路交通事故認定工作所存在的問題進行了深入分析,并針對當(dāng)事人對道路事故認定不服的救濟方式不足、交通事故認定規(guī)則不足、道路交通事故認定中的困惑、道路交通事故認定的監(jiān)督和制約及救濟途經(jīng)存在弊端、事故處理民警的能力素質(zhì)亟待提高等方面的問題提出完善道路交通事故認定的措施。
[Abstract]:With the rapid development of our country's economy and society, the flow of personnel and materials is unprecedentedly frequent, the quantity of car ownership and the number of drivers in the whole society are increasing rapidly, but the growth rate of road traffic mileage is relatively slow, and the construction of road safety facilities is lagging behind. The contradiction between people, cars, roads and environment is highlighted. The number of road traffic accidents has also increased rapidly. The occurrence of road traffic accidents seriously threatens the safety of people's life and property. According to incomplete statistics, in recent years, more than 15 million road traffic accidents have occurred in China, causing more than 15 people to be injured, resulting in more than 7 deaths, resulting in the property loss of nearly 1 billion yuan. After the accident, every party and his family are hoping to get a fair treatment and get a reasonable compensation for the accident damage. The traffic management department of the public security organ is the legal subject to deal with the road traffic accidents. In the road traffic accident treatment, the road traffic accident is identified as the most important link. Road traffic accident. It is a legal and professional work, which is the specific analysis and confirmation of the basic facts of traffic accidents, the cause of the traffic accidents and the liability of the parties, and the liability for accidents. There are insufficient relief methods for the parties to the road accident identification, the lack of the identification rules of traffic accidents, the confusion in the identification of road traffic accidents, the supervision and restriction of road traffic accident identification and the disadvantages of the relief ways, and the problems in the ability to improve the ability of the police to deal with the accident, and to improve the identification of road traffic accidents.
