【摘要】：城市管理綜合執(zhí)法是相對集中行政處罰權(quán)的產(chǎn)物,執(zhí)法權(quán)的集中和執(zhí)法重心的下沉是大都市管理綜合執(zhí)法改革的兩條主線。執(zhí)法權(quán)的集中體現(xiàn)在從分散執(zhí)法向綜合集中執(zhí)法轉(zhuǎn)變;執(zhí)法重心下沉強調(diào)執(zhí)法重心開始從市、區(qū)兩級向街鎮(zhèn)延伸,解決基層執(zhí)法中的權(quán)責(zé)不對稱、管理力量短缺等問題。綜合執(zhí)法改革的推進有利于破解執(zhí)法力量分散所導(dǎo)致的管理碎片化、多頭交叉執(zhí)法等問題,是整體性治理理念在城市管理領(lǐng)域的延伸、技術(shù)上的升級和功能上的拓展。但也應(yīng)看到,其本質(zhì)仍是一種以事后管制為中心的強政府思維的延續(xù),在治理一些需要短期內(nèi)集中整治的問題上具有較大優(yōu)勢,但在源頭防范和長效機制形成方面則存在明顯的不足,仍需更為關(guān)注城市管理中"上游"的防控。
[Abstract]:Comprehensive law enforcement of urban management is the product of relatively centralized administrative punishment power. The concentration of law enforcement power and the sinking of law enforcement center are the two main lines of the comprehensive law enforcement reform of metropolitan management. The centralization of law enforcement power is reflected in the transformation from decentralized law enforcement to comprehensive centralized law enforcement, and the sinking of law enforcement center emphasizes that the law enforcement center begins to extend from the city to the street town at the district and district levels, thus solving the problems of asymmetry of power and responsibility and shortage of management power in the law enforcement at the grass-roots level. The promotion of comprehensive law enforcement reform is helpful to solve the problems of fragmentation of management and multi-crossing law enforcement caused by the dispersion of law enforcement. It is the extension of the concept of holistic governance in the field of urban management, the upgrading of technology and the expansion of function. However, it should also be noted that its essence is still a continuation of a strong government thinking centered on ex post control, and it has a great advantage in dealing with some problems that need to be centralized in the short term. However, there are obvious deficiencies in source prevention and long-term mechanism formation, and more attention should be paid to the prevention and control of "upstream" in urban management.
