【摘要】：由于私法和市場(chǎng)經(jīng)濟(jì)不能自動(dòng)消除貧困、失業(yè)、貧富分化、收入分配不公等現(xiàn)象,不能自發(fā)地實(shí)現(xiàn)社會(huì)公正,必須由國家介入才能解決,由此催生了社會(huì)法"國家干預(yù)與私法自治相結(jié)合"的法律機(jī)制。作為積極國家法律實(shí)踐的產(chǎn)物,社會(huì)法行政執(zhí)法機(jī)制的理論來源是積極自由、積極權(quán)利和人權(quán)學(xué)說,與其他法律部門有很大的不同,其主要特征是國家給付、國家干預(yù)與市場(chǎng)機(jī)制相結(jié)合,積極執(zhí)法與消極執(zhí)法相結(jié)合。
[Abstract]:Since private law and market economy cannot automatically eliminate poverty, unemployment, polarization between the rich and the poor, unfair income distribution, and so on, social justice cannot be achieved spontaneously, and only through the intervention of the state can it be solved. This gave birth to the legal mechanism of the combination of state intervention and private law autonomy. As a product of active national legal practice, the theoretical source of the administrative law enforcement mechanism of social law is the doctrine of positive freedom, positive rights and human rights, which is very different from other legal departments, and its main characteristic is payment by the state. State intervention and market mechanism, active law enforcement and negative law enforcement.
