【摘要】:隨著我國經(jīng)濟(jì)的迅速發(fā)展,出租車以舒適、方便、快捷和服務(wù)范圍廣的特點(diǎn)區(qū)別于其他公交方式,成為城市公共交通的重要組成部分。出租車行業(yè)同時(shí)具有公用性和市場性的屬性,具有運(yùn)營獨(dú)立、分散、為個(gè)體服務(wù)的特點(diǎn)。由于我國出租車行業(yè)長期實(shí)行特許經(jīng)營以及政府嚴(yán)格控制出租車的總量,出租車市場出現(xiàn)了供求失衡的局面,各地“出租車罷運(yùn)”事件頻繁發(fā)生。經(jīng)歷了長達(dá)六、七年的呼吁、探討,2015年,政府終于下決心開始改革。但是出租車改革涉及政府、出租車公司、司機(jī)多方主體的利益,打車難、“黑車”盛行、司機(jī)收入低,服務(wù)質(zhì)量差等問題使改革困難重重。雖然引起這些問題的原因各不相同,但歸根到底大都和出租車行業(yè)的政府監(jiān)管有關(guān),出租車行業(yè)的政府監(jiān)管政策也就成為社會(huì)關(guān)注的焦點(diǎn)和困擾政府立法以及執(zhí)法工作的難點(diǎn)。因此,本文試從法律的角度分析當(dāng)前我國出租車行業(yè)政府監(jiān)管存在的法律問題,提出了一些具體的監(jiān)管政策和立法建議,希望為我國出租車行業(yè)政府監(jiān)管模式的構(gòu)建提供一些新思路。本文第一部分闡述了出租車行業(yè)的屬性和特征,介紹了政府監(jiān)管的一般性理論,分析了我國出租車行業(yè)政府監(jiān)管的法律關(guān)系,為后文的展開論述奠定了理論基礎(chǔ)。本文第二部分首先從立法、運(yùn)行兩個(gè)方面介紹了我國出租車行業(yè)政府監(jiān)管的基本情況,然后從法律體系、特許經(jīng)營、具體管制措施以及政府執(zhí)法責(zé)任落實(shí)這四個(gè)方面重點(diǎn)分析當(dāng)前我國出租車行業(yè)政府監(jiān)管中的法律問題,以期突出問題的嚴(yán)重性與可研究性。本文第三部分針對(duì)第三部分發(fā)現(xiàn)的法律問題,對(duì)癥下藥,從法律體系的完善、將出租車行業(yè)納入一般許可、制定準(zhǔn)則規(guī)范各種管制手段的運(yùn)用以及平衡出租車行業(yè)政府監(jiān)管的權(quán)責(zé)這幾個(gè)方面,提出了一些具體的解決建議。
[Abstract]:With the rapid development of economy in our country, taxi has become an important part of urban public transportation because of its comfort, convenience, rapidity and wide service range, which is different from other public transportation modes. Taxi industry has the characteristics of public and market, independent operation, decentralized service for the individual. Because of the long period of franchise and the strict control of the total amount of taxi in our country, the taxi market has been out of balance between supply and demand, and the "taxi strike" has occurred frequently. After six or seven years of appeal and discussion, the government finally made up its mind to begin reform in 2015. However, the reform of taxis involves the interests of the government, taxi companies and drivers. It is difficult to take a taxi. The prevalence of "black cars", the low income of drivers and the poor service quality make the reform difficult. Although the causes of these problems are different, in the final analysis, most of them are related to the government supervision of the taxi industry, and the government supervision policy of the taxi industry has become the focus of attention and the difficulty of the government legislation and law enforcement. Therefore, this paper tries to analyze the legal problems existing in the government supervision of taxi industry in China from the legal point of view, and puts forward some specific regulatory policies and legislative suggestions. The author hopes to provide some new ideas for the construction of government supervision mode of taxi industry in China. The first part of this paper expounds the attributes and characteristics of the taxi industry, introduces the general theory of government supervision, analyzes the legal relationship of the government supervision of the taxi industry in China, and lays a theoretical foundation for the following discussion. The second part of this paper first introduces the basic situation of the government supervision of taxi industry in China from two aspects of legislation and operation, and then from the legal system, franchise, In order to highlight the seriousness and researchability of the problems, the specific control measures and the implementation of the law enforcement responsibility of the government focus on analyzing the legal problems in the government supervision of the taxi industry in our country at present. In the third part of this paper, aiming at the legal problems found in the third part, the author puts forward the remedy to the case, from the perfection of the legal system, bringing the taxi industry into the general license. In order to regulate the use of various means of regulation and balance the power and responsibility of taxi industry government supervision, the author puts forward some concrete suggestions to solve the problem.
