我國公務(wù)員社會養(yǎng)老保險法律問題研究

【摘要】:自新中國成立以來,我國政府一直未就養(yǎng)老保險制度問題作出統(tǒng)一的系統(tǒng)性的整體設(shè)計,,造成在我國范圍內(nèi)包括公務(wù)員養(yǎng)老保險、城鄉(xiāng)基本養(yǎng)老保險等在內(nèi)的多種養(yǎng)老保險模式并存的局面,而且這幾種養(yǎng)老保險模式之間存在著體制差異、城鄉(xiāng)差異、地區(qū)差異等隔閡,導(dǎo)致在不同模式下養(yǎng)老保險金差距懸殊以及養(yǎng)老保險關(guān)系不能進(jìn)行順暢轉(zhuǎn)接等現(xiàn)實問題。養(yǎng)老保險制度,作為國家社會保障制度的重要組成部分,在方方面面都發(fā)揮著不可替代的重要作用。但是,與我國現(xiàn)行經(jīng)濟(jì)體制和社會保障體系相匹配的公務(wù)員社會養(yǎng)老保險制度卻一直未能得到確立,這就阻礙了我國進(jìn)一步深化改革戰(zhàn)略的實施,所以我國要盡快建立起一套屬于中國自己的公務(wù)員社會養(yǎng)老保險制度。針對上述問題,筆者通過認(rèn)識和發(fā)現(xiàn)問題、分析問題和解決問題的脈絡(luò),對建構(gòu)公務(wù)員社會養(yǎng)老保險的法律問題作以研究,闡述說明一些自己的觀點,期望能有助于問題的解決。本文共分三部分: 第一部分為我國建立公務(wù)員社會養(yǎng)老保險制度的必要性與可行性分析。本部分首先對公務(wù)員社會養(yǎng)老保險的概念進(jìn)行理論探討和界定,并對我國公務(wù)員養(yǎng)老保險制度的歷史沿革加以闡述,并說明我國建立公務(wù)員社會養(yǎng)老保險制度的作用和意義,最后充分全面的對我國建立公務(wù)員社會養(yǎng)老保險制度進(jìn)行必要性和可行性的論證。 第二部分為域外公務(wù)員社會養(yǎng)老保險模式的比較及啟示。本部分首先是介紹域外各國比較成熟的社會養(yǎng)老保險理論,進(jìn)而從立法體例、適用范圍、籌資模式、管理體制等方面對其進(jìn)行比較分析,最后總結(jié)提煉出域外比較成熟的公務(wù)員社會養(yǎng)老保險模式對建立符合我國國情的具有中國特色的公務(wù)員社會養(yǎng)老保險制度具有重要借鑒意義的啟示。 第三部分為我國建立公務(wù)員社會養(yǎng)老保險的基本制度構(gòu)想。本部分是本文的重中之重,是在第一章的必要性與可行性分析、第二章的比較分析得出的啟示的基礎(chǔ)上,針對如何建立我國公務(wù)員社會養(yǎng)老保險制度提出合理可行的構(gòu)想。本部分首先對建立公務(wù)員社會養(yǎng)老保險制度應(yīng)秉承的原則、具體內(nèi)容、配套措施。
[Abstract]:Since the founding of the people's Republic of China, the Chinese government has not made a unified and systematic overall design on the issue of the old-age insurance system, resulting in the inclusion of pension insurance for civil servants within the scope of our country. The coexistence of various old-age insurance modes, including basic old-age insurance in urban and rural areas, and the gap between these pension insurance modes, such as system differences, urban-rural differences, regional differences, etc. It leads to the gap between pension and pension insurance in different modes and the lack of smooth transfer of pension insurance relationship and other practical problems. As an important part of the national social security system, the old-age insurance system plays an irreplaceable role in every aspect. However, the social old-age insurance system of civil servants, which matches the current economic system and social security system of our country, has not been established, which hinders the implementation of the strategy of further deepening the reform in our country. Therefore, our country should set up a set of civil servants'social endowment insurance system as soon as possible. In view of the above problems, the author studies the legal problems of constructing the social endowment insurance of civil servants by understanding and discovering the problems, analyzing the context of the problems and solving the problems, and expounds some of his own views. Hope will help to solve the problem. This paper is divided into three parts: The first part analyzes the necessity and feasibility of establishing the social endowment insurance system for civil servants in China. This part firstly discusses and defines the concept of social endowment insurance for civil servants theoretically, and expounds the historical evolution of the pension insurance system for civil servants in our country, and explains the role and significance of establishing the social endowment insurance system for civil servants in our country. Finally, the necessity and feasibility of establishing the social endowment insurance system for civil servants in China are fully and comprehensively demonstrated. The second part is the comparison and enlightenment of the overseas civil servant social endowment insurance model. This part firstly introduces the mature social endowment insurance theory in foreign countries, and then makes a comparative analysis on it from the aspects of legislative style, scope of application, financing model, management system, etc. Finally, the author summarizes and abstracts out the more mature mode of civil servant social endowment insurance, which is of great significance to the establishment of the civil servant social endowment insurance system with Chinese characteristics, which is in line with the national conditions of our country. The third part is the conception of the basic system of establishing the social endowment insurance for civil servants in our country. This part is the most important part of this article, is in the first chapter of the necessity and feasibility analysis, the second chapter of the comparative analysis of the basis of enlightenment, in view of how to establish our civil servants social endowment insurance system put forward reasonable and feasible ideas. This part first of all to establish the civil servant social endowment insurance system should uphold the principle, the concrete content, the supporting measure.
