【摘要】：質(zhì)量安全事關(guān)企業(yè)的生存和發(fā)展,更關(guān)系到百姓生活的衣食住行,是維系社會穩(wěn)定和提升國家形象的重要一環(huán)。作為對質(zhì)量安全負(fù)有監(jiān)管職責(zé)的政府職能部門，質(zhì)量技術(shù)監(jiān)督部門越來越受到公眾的關(guān)注。而質(zhì)量技術(shù)監(jiān)督行政執(zhí)法作為質(zhì)量技術(shù)監(jiān)督部門履行職能的重要手段，伴隨質(zhì)量技術(shù)監(jiān)督事業(yè)的前進(jìn)發(fā)展雖然也取得了長足的進(jìn)步，，但是在實(shí)踐執(zhí)法過程中仍然暴露出一些問題，媒體報道披露的各種質(zhì)量安全隱患和不時發(fā)生的重大質(zhì)量安全事件，不斷拷問著質(zhì)量技術(shù)監(jiān)督行政執(zhí)法的權(quán)威性和公信力。 泉州是東南沿海經(jīng)濟(jì)發(fā)展最活躍的城市之一，國民生產(chǎn)總值已連續(xù)14年居福建省首位，其獨(dú)特的經(jīng)濟(jì)模式和產(chǎn)業(yè)結(jié)構(gòu)引發(fā)的產(chǎn)品質(zhì)量監(jiān)督管理問題頗具典型性和代表性。本文以泉州市質(zhì)量技術(shù)監(jiān)督行政執(zhí)法的現(xiàn)狀為研究對象，以政府管制理論和新公共服務(wù)理論為指導(dǎo)，通過運(yùn)用文獻(xiàn)研究法、實(shí)證調(diào)研法和比較研究法，在闡明質(zhì)量技術(shù)監(jiān)督行政執(zhí)法基本概念和法律依據(jù)的基礎(chǔ)上，對泉州市質(zhì)量技術(shù)監(jiān)督行政執(zhí)法的發(fā)展歷程和取得的成就進(jìn)行介紹，重點(diǎn)探討泉州市在質(zhì)量技術(shù)監(jiān)督行政執(zhí)法當(dāng)中所存在的法律法規(guī)的被執(zhí)行力弱化問題、執(zhí)法主體存在多頭執(zhí)法的問題和行政執(zhí)法行為方面的問題，進(jìn)一步分析導(dǎo)致上述問題產(chǎn)生的執(zhí)法管理體制滯后、執(zhí)法人員素質(zhì)不高、執(zhí)法環(huán)境有待改善和缺乏有效執(zhí)法監(jiān)督四個原因，隨后在借鑒發(fā)達(dá)國家成熟的質(zhì)量監(jiān)督機(jī)制和國內(nèi)某些地區(qū)有關(guān)質(zhì)量技術(shù)監(jiān)督行政執(zhí)法方面先進(jìn)經(jīng)驗(yàn)的基礎(chǔ)上，從改革質(zhì)量技術(shù)監(jiān)督行政執(zhí)法體制、加強(qiáng)質(zhì)量技術(shù)監(jiān)督執(zhí)法隊(duì)伍建設(shè)、改善質(zhì)量技術(shù)監(jiān)督行政執(zhí)法環(huán)境以及強(qiáng)化質(zhì)量技術(shù)監(jiān)督行政執(zhí)法監(jiān)督四個方面，提出完善泉州質(zhì)量技術(shù)監(jiān)督行政執(zhí)法的具體對策建議。
[Abstract]:Quality and safety is related to the survival and development of enterprises, as well as to the daily life of the people. It is also an important link to maintain social stability and improve the image of the country. As a government functional department with responsibility for quality and safety supervision, quality and technology supervision department has been paid more and more attention by the public. As an important means for the quality and technology supervision departments to perform their functions, quality and technology supervision administrative law enforcement has made considerable progress with the development of quality and technology supervision. However, some problems are still exposed in the process of practical law enforcement. Various quality and safety hidden dangers and major quality and safety incidents that occur from time to time in media reports are constantly being questioned about the authority and credibility of quality and technical supervision in administrative law enforcement. Quanzhou is one of the most active cities in the southeast coastal area. The gross national product (GNP) has been ranked first in Fujian province for 14 consecutive years. The problems of product quality supervision and management caused by its unique economic model and industrial structure are quite typical and representative. In this paper, the current situation of quality and technical supervision and law enforcement in Quanzhou City is taken as the research object, the government regulation theory and the new public service theory as the guidance, through the use of literature research, empirical research and comparative research method. On the basis of expounding the basic concept and legal basis of administrative law enforcement of quality and technical supervision, this paper introduces the development course and achievements of quality and technical supervision administrative law enforcement in Quanzhou. It focuses on the weakening of the enforcement of laws and regulations in Quanzhou City in the process of quality and technical supervision and administrative law enforcement, the existence of multiple law enforcement problems and administrative law enforcement behavior problems in the subject of law enforcement. Further analysis of the four reasons for the lag of the law enforcement management system, the low quality of law enforcement personnel, the need to improve the law enforcement environment and the lack of effective law enforcement supervision, Then, on the basis of drawing lessons from the mature quality supervision mechanism of developed countries and the advanced experience of some regions in China in the field of quality and technical supervision and administrative law enforcement, and on the basis of reforming the system of quality and technical supervision and administrative law enforcement, Strengthening the construction of quality and technology supervision, improving the administrative law enforcement environment of quality and technology supervision and strengthening the quality and technology supervision administrative law enforcement supervision, this paper puts forward some concrete countermeasures and suggestions for improving the quality and technology supervision administrative law enforcement in Quanzhou.
