【摘要】：云計算時代網(wǎng)絡(luò)輿情引導(dǎo)法律機制的研究，是將網(wǎng)絡(luò)輿情的研究置于與計算時代的社會背景下，力求得出與時代相適應(yīng)的網(wǎng)絡(luò)輿情引導(dǎo)法律機制的構(gòu)建方式。網(wǎng)絡(luò)輿情是通過互聯(lián)網(wǎng)表達和傳播的各種不同情緒、態(tài)度和意見交錯的總和。目前，我國正處于社會轉(zhuǎn)型的關(guān)鍵時期，網(wǎng)絡(luò)輿情的引導(dǎo)面臨著各種各樣的問題，這不僅影響著我國網(wǎng)絡(luò)輿情的良性發(fā)展，也影響著我國民主化進程以及社會的和諧穩(wěn)定。本文從云計算時代網(wǎng)絡(luò)輿情的內(nèi)涵界定出發(fā)，深入探討輿論、輿情、民意的概念，從而得出云計算時代網(wǎng)絡(luò)輿情的應(yīng)有之義，在確定了論題的理論范疇之后，結(jié)合我國網(wǎng)絡(luò)輿情引導(dǎo)機制的現(xiàn)狀以及域外考察的啟示，進一步研究云計算時代網(wǎng)絡(luò)輿情引導(dǎo)法律機制的構(gòu)建應(yīng)具備的制度基礎(chǔ)，即政府信息公開與政務(wù)透明化，公民言論自由、新聞傳播權(quán)等私權(quán)利的保障等配套制度基礎(chǔ)。在以上循序漸進的研究的基礎(chǔ)之上，探討我國網(wǎng)絡(luò)輿情引導(dǎo)法律機制構(gòu)建的立法完善，，主要從完善網(wǎng)絡(luò)媒體規(guī)范法律制度出發(fā)，建立國家級網(wǎng)絡(luò)輿情檢測云平臺運行的法律機制，并在此平臺上構(gòu)建網(wǎng)絡(luò)輿情信息分級預(yù)警機制。
[Abstract]:The research on the legal mechanism of network public opinion guidance in cloud computing age is to put the research of network public opinion under the social background of the computing era and try to get the construction method of the network public opinion guiding legal mechanism which is adapted to the times. Internet public opinion is the sum of different emotions, attitudes and opinions expressed and transmitted through the Internet. At present, our country is in the critical period of social transformation, the guidance of network public opinion is facing a variety of problems, which not only affects the benign development of China's network public opinion, but also affects the democratization process and social harmony and stability. This article starts from the cloud computing era network public opinion connotation definition, deeply discusses the public opinion, the public opinion concept, thus obtains the cloud computing time network public opinion due meaning, after has determined the topic theory scope, Combined with the current situation of the guiding mechanism of network public opinion in our country and the enlightenment of overseas investigation, this paper further studies the institutional basis for the construction of the legal mechanism of network public opinion guidance in cloud computing era, that is, government information openness and transparency of government affairs. Civil freedom of speech, the right to spread news and other private rights protection and other supporting system basis. On the basis of the above step by step research, this paper probes into the legislative perfection of the legal mechanism guided by the network public opinion in our country, mainly from the view of perfecting the legal system of the network media standardization. The legal mechanism of network public opinion detection cloud platform is established, and the hierarchical warning mechanism of network public opinion information is constructed on this platform.
