【摘要】:在現(xiàn)代社會,,機動車己成為不可缺少的交通工具,其在給人們帶來便利的同時,也帶來了巨大的交通風險。一起起交通事故的發(fā)生,觸目驚心,給人們帶來心靈上的巨大震撼,同時,也引發(fā)了人們對交通事故頻發(fā)原因的思考。筆者作為一名基層的執(zhí)業(yè)律師,參與過道路交通事故人身損害賠償案件的處理,對其中一些較為典型和疑難的案件,進行過較為深入的分析和探討。每一起交通事故的發(fā)生,都與交通參與者的義務(wù)違反行為有關(guān),對于機動車方來說,許多交通事故的發(fā)生起因在其對作為義務(wù)的違反。本文擬從以下三個部分進行分析,結(jié)合司法審判實踐案例,對道路交通參與者機動車方的作為義務(wù)相關(guān)問題進行探討。 第一部分:道路交通參與者機動車方作為義務(wù)的理論基礎(chǔ)與法理分析。本部分主要介紹了道路交通參與者作為義務(wù)的理論背景,分析道路交通參與者機動車方作為義務(wù)的理論基礎(chǔ),并從危險控制理論、信賴關(guān)系理論、獲利關(guān)系理論三個方面對道路交通參與者作為義務(wù)的法理基礎(chǔ)進行探討。 第二部分:道路交通參與者機動車方作為義務(wù)的內(nèi)容。本章通過對道路交通參與者——機動車駕駛員、機動車所有權(quán)人及掛靠單位的作為義務(wù)進行分析,對機動車方的作為義務(wù)進行了較為細致的歸類,闡明了道路交通機動車方在參與道路交通過程中應(yīng)盡的作為義務(wù)。 第三部分:道路交通參與者機動車方作為義務(wù)的合理化分析。筆者通過對道路交通參與者的作為義務(wù)進行分析,對作為義務(wù)的合理分配與合理限度方面提出自己的一些看法和建議。
[Abstract]:In modern society, motor vehicle has become an indispensable means of transportation, which not only brings convenience to people, but also brings huge traffic risks. The occurrence of a traffic accident, shocking, bring people a great shock in their hearts, at the same time, it also causes people to think about the causes of frequent traffic accidents. As a practicing lawyer at the basic level, the author has participated in dealing with the cases of compensation for personal injury in road traffic accidents, and has made a more in-depth analysis and discussion on some of the more typical and difficult cases. The occurrence of every traffic accident is related to the breach of the duty of the traffic participant. For the motor vehicle side, many traffic accidents are caused by the breach of the duty to act. This paper analyzes the following three parts, and discusses the problems related to the road traffic participants' motor vehicles' obligations combined with the practical cases of judicial trial. The first part: the theoretical basis and legal analysis of the road traffic participant motor vehicle as the obligation. This part mainly introduces the theoretical background of road traffic participants as obligations, analyzes the theoretical basis of road traffic participants as obligations, and from the hazard control theory, trust relationship theory. Three aspects of profit relation theory to discuss the road traffic participants as the legal basis of obligations. The second part: the content of the road traffic participant motor vehicle as the obligation. In this chapter, through the analysis of the road traffic participants-motor vehicle drivers, motor vehicle owners and related units as obligations, the motor vehicle side of the obligations of the more detailed classification, This paper expounds the duty that motor vehicles should perform in the process of participating in road traffic. The third part: the rational analysis of the road traffic participant motor vehicle side as the obligation. Based on the analysis of the duties of road traffic participants, the author puts forward some opinions and suggestions on the reasonable distribution and limitation of the duties of road traffic.
