行政復(fù)議和解標(biāo)的之拓展考

【摘要】:2007年,《行政復(fù)議法實(shí)施條例》創(chuàng)設(shè)了行政復(fù)議和解制度,首次將和解這一“鄉(xiāng)土中國”的傳統(tǒng)解紛方式引入行政救濟(jì)規(guī)范。目前,行政復(fù)議和解相關(guān)法律規(guī)范僅將行政復(fù)議和解的標(biāo)的確定為行政裁量,行政復(fù)議和解實(shí)踐因此“循規(guī)蹈矩”,將行政復(fù)議和解標(biāo)的限于行政裁量中的和解,這阻礙了行政復(fù)議和解制度優(yōu)勢的極大發(fā)揮。不過,與此同時(shí),也有部分行政復(fù)議相關(guān)案例的和解實(shí)踐積極回應(yīng)了行政復(fù)議過程對(duì)事實(shí)不清或法律關(guān)系不明狀態(tài)等裁量以外的標(biāo)的進(jìn)行和解的制度可能。對(duì)相關(guān)行政復(fù)議法律規(guī)范的規(guī)范解讀顯示,行政復(fù)議和解標(biāo)的并非僅限于行政裁量,事實(shí)不清或法律關(guān)系不明狀態(tài)納入復(fù)議和解的標(biāo)的范圍符合行政復(fù)議和解法律規(guī)范的漏洞填補(bǔ)疆域,而且國內(nèi)外學(xué)界關(guān)于事實(shí)不清或法律關(guān)系不明狀態(tài)下締結(jié)和解契約的探討,也為行政復(fù)議和解標(biāo)的拓展至事實(shí)不清或法律關(guān)系不明狀態(tài)下的和解提供了理論支持,行政復(fù)議過程中對(duì)事實(shí)不清或法律關(guān)系不明等裁量以外的標(biāo)的進(jìn)行和解并無制度障礙。但是,我們也應(yīng)看到,在行政復(fù)議和解標(biāo)的拓展進(jìn)路中,行政復(fù)議個(gè)案基于事實(shí)不清或法律關(guān)系不明狀態(tài)下的和解存在侵害依法行政與公共利益的風(fēng)險(xiǎn),防范行政復(fù)議過程中的個(gè)案和解侵害依法行政與公共利益,應(yīng)成為行政復(fù)議和解標(biāo)的拓展制度設(shè)計(jì)中的關(guān)鍵。具體包括個(gè)案復(fù)議和解應(yīng)基于公眾參與和誠實(shí)信用運(yùn)作,以締結(jié)和解協(xié)議為必要,以公開為原則,以不公開為例外。
[Abstract]:In 2007, the regulations on the implementation of the Administrative reconsideration Law established the system of administrative reconsideration and reconciliation, which for the first time introduced reconciliation, the traditional solution of "native China", into the standard of administrative relief. At present, the relevant legal norms of administrative reconsideration and reconciliation only determine the object of administrative reconsideration and settlement as administrative discretion, so the practice of administrative reconsideration and reconciliation "follows the rules" and limits the subject of administrative reconsideration settlement to settlement in administrative discretion. This hinders the great advantage of the administrative reconsideration and reconciliation system. However, at the same time, there are some cases of administrative review related to the settlement of the practice of positive response to the administrative review process of unclear facts or unclear legal relations such as the status of the settlement of the system other than the system. The normative interpretation of the relevant legal norms of administrative reconsideration shows that the object of settlement of administrative reconsideration is not limited to administrative discretion, The scope of the object of the reexamination and settlement is in accordance with the loopholes in the legal norms of administrative reconsideration and reconciliation. Moreover, the scholars at home and abroad discuss the conclusion of the settlement contract under the condition of unclear facts or unclear legal relations. It also provides theoretical support for the expansion of the subject of administrative reconsideration settlement to the settlement in the state of unclear facts or unclear legal relations. In the process of administrative reconsideration, there are no institutional obstacles to the settlement of objects other than unclear facts or unclear legal relations. However, we should also see that in the course of the expansion of the subject of administrative reconsideration settlement, the settlement of administrative reconsideration cases based on unclear facts or unclear legal relations has the risk of encroaching on the administrative and public interests according to law. To prevent the case settlement in the process of administrative reconsideration from encroaching on the administration according to law and public interests should be the key to the design of the expansion system of the subject of administrative reconsideration settlement. In particular, the case review and settlement should be based on public participation and good faith operation, the conclusion of a settlement agreement is necessary, the principle of openness is open, and the exception is not open.
