【摘要】：警察含義是警察立法的邏輯起點(diǎn),警察立法活動(dòng)就是把警察學(xué)理上含義轉(zhuǎn)化為實(shí)定法上含義。警察含義之于警察立法有警察屬性、警察功能和警察權(quán)力結(jié)構(gòu)三個(gè)核心問(wèn)題。我國(guó)當(dāng)前的警察立法,應(yīng)突出警察的行政屬性;在警察積極行政功能、消極行政功能和協(xié)助其他行政功能上進(jìn)行完整的、合理的配置,在國(guó)家治理現(xiàn)代化背景下,把警察治理雙向度化、治理主體的多元化、治理手段的柔性化反映在警察立法中,進(jìn)一步突出警察的民事屬性;在警察權(quán)力結(jié)構(gòu)上,進(jìn)一步完善警察中央事權(quán)、地方事權(quán)、中央與地方共同事權(quán)的配置。
[Abstract]:The meaning of the police is the logical starting point of the legislation of the police, and the legislative activity of the police is to transform the theoretical meaning of the police into the real meaning of the law. The meaning of police has three core problems: police attribute, police function and police power structure. The present police legislation in our country should emphasize the administrative attributes of the police, make a complete and reasonable arrangement on the active administrative function, negative administrative function and assisting other administrative function of the police, and in the context of the modernization of the country's governance, In the police power structure, the police power structure should be further improved, the central power of the police should be further improved, and the local administrative power should be further improved, and the flexibility of the governance measures should be reflected in the police legislation, and the civil attributes of the police should be further highlighted. The allocation of common administrative power between the central and local governments.
