【摘要】：農(nóng)村土地"三權(quán)分置"是經(jīng)濟(jì)學(xué)主導(dǎo)農(nóng)村土地改革政策的形象表述,該學(xué)說能很好解釋實踐中農(nóng)地流轉(zhuǎn)現(xiàn)象。但經(jīng)濟(jì)學(xué)界對于"三權(quán)分置"實施可行性的解釋,主要以西方產(chǎn)權(quán)理論為基礎(chǔ),以權(quán)能分離理論為指導(dǎo)思想。這種經(jīng)濟(jì)學(xué)邏輯并不符合當(dāng)前的法律邏輯。法學(xué)界針對經(jīng)濟(jì)學(xué)界權(quán)能分離理論的"三權(quán)分置"展開了批判,提出承包權(quán)與經(jīng)營權(quán)分離,事實上是對農(nóng)地所有權(quán)用益權(quán)能的再分割,有悖所有權(quán)的整體性特征。但法學(xué)界"基于文本尋找解釋"的研究思路,決定了其無法對現(xiàn)實當(dāng)中大量存在的違背規(guī)范性土地承包、農(nóng)地流轉(zhuǎn)的現(xiàn)象做出解釋。在分析經(jīng)濟(jì)學(xué)和法學(xué)關(guān)于農(nóng)村土地"三權(quán)分置"政策的理論解讀的基礎(chǔ)上,設(shè)定土地承包權(quán)為成員權(quán),創(chuàng)設(shè)具有物權(quán)效力的土地經(jīng)營權(quán)取代原土地承包經(jīng)營權(quán),這種土地產(chǎn)權(quán)制度符合物權(quán)分離邏輯,能夠在法權(quán)構(gòu)造上自洽,在立法技術(shù)和修法成本上具有優(yōu)勢。
[Abstract]:The "three rights division" of rural land is the image expression of the rural land reform policy led by economics, and this theory can explain the phenomenon of agricultural land circulation in practice. However, the explanation of the feasibility of the implementation of the "three power separation" in the field of economics is mainly based on the western theory of property rights and the theory of separation of power as the guiding ideology. This economic logic does not conform to the current legal logic. In the view of the theory of separation of power and power in the field of economics, the field of law criticizes the separation of the right of contract from the right of management, which is in fact a redivision of the power of use of interest in the ownership of agricultural land, which is contrary to the overall characteristics of ownership. However, the research idea of "looking for interpretation based on text" in the field of law decides that it can not explain the phenomenon of violating the norm of land contract and transferring farmland in reality. On the basis of analyzing the theoretical interpretation of the policy of "three rights separation" of rural land in economics and law, the author establishes the land contract right as the member right, and creates the land management right with real right effect to replace the original land contract management right. This kind of land property right system accords with the logic of property right separation, and can accord with itself in the legal right construction, and has the advantage in the legislative technology and the cost of amending the law.
