【摘要】：權力清單是我國黨政機構的自我限權措施,但由黨政自身開列權力清單,有越權之嫌;法治社會約束公權已有"法不授權則不為"原則,權力清單不具有超越"法不授權則不為"的優(yōu)越性,花大力氣推出權力清單的意義和價值合理性值得商榷;尤其是,我國目前政府和市場、政府和社會的關系尚未厘清,在這前提下劃定行政機關的權力清單也難以科學合理。現(xiàn)代政務管理的核心是法治和依法行政,管理部門沒有必要在這個原則問題上搞創(chuàng)新,法律也不允許這種創(chuàng)新。依法行政要求的是嚴格遵循法律,否則就會背離法治的原則。
[Abstract]:The list of powers is the self-limiting measure of the party and government organization in our country, but the party and government make the list of power by themselves, it seems that the power exceeds the authority, and the rule of law society restricts the public power, which has the principle that "if the law does not authorize, the power will not be authorized". The list of powers does not have the advantage of surpassing "the law does not authorize, do not do". The significance and value rationality of putting forward the list of power with great effort is debatable; especially, at present, the relationship between government and market, government and society in our country has not been clarified. Under this premise, it is difficult to define the power list of administrative organs. The core of modern government administration is the rule of law and administration by law, and the management department does not need to innovate on this principle, nor does the law allow such innovation. Administration according to law requires strict adherence to the law, otherwise it will deviate from the principle of rule of law.
